then why weren't they declared kufar or murtadeen, in fact many of these people were religious scholars and had High positions in Governments which ruled by Shari'ah Law. Al-Biruni was in the court of Mahmoud Ghaznawi who is called "damar-e-taghout"; why wouldn't Mahmoud Ghaznawi declare al-Biruni an apostate for his views on Evolution?
