will you provide evidence from the qur'an and sunnah of rasulallah (saw) which suggest that people found guilty of adultery are not to be stoned?

there is a testimony of guilt from either the suspected party and/or four witnesses required and the prescribed punishment ordained by Allah(swt) clearly in the Qur'an is to then be carried out.

Actually he is right, in Islam we don't look for reasons to punish people, we look for reasons NOT to punish them. for the very reason that Allah (swt)'s punishment is severe.

There is a hadith regarding this issue, perhaps someone with more available resources can cite this hadith.

This doesn't mean abandoning Allah(swt)'s law but that we look for Allah(swt)'s mercy first then apply punishments if NEEDED.

Scimitar the islamic shariah ordains stoning for those found guilty of extramarital relations either through their own testimony or that of 4 witnesses. if we abstain from or deny having to fulfill the prescribed punishment, we are guilty of KUFR because in essence you are denying with ALLAH'S law which was always carried out by His infallible Messenger.

I also do not agree with the views being promoted here which reject capital punishment. Capital Punishment for certain crimes, including sexual immoralities do in fact exist in Islam, there is no apologetics for it. But we must also take heed on the strict and necessary process of investigations REQUIRED in Islam and must not be quick to act on capital crimes without thorough and complete assessment.

remember Allah (swt) says MERCY BEFORE HIS WRATH!!!

If you people are not comfortable with Islam in its entirety and its mandates, please you are entitled to freedom of religion. It is worse to be a hypocrite than a non-Muslim.

We've established this, the Shari'ah also ordains looking for reasons NOT to administer such a punishment. I can't give a precise Hadith reference at this time but read Al-Ahkam Al-Sultaniyah; which is comprehensive assessment of what the penal code of an islamic state should be it references the Hadith regarding taking the desire to be merciful to the perpetrator if we can find just reason for being.

Lacking this information is clearly a travesty and merely hijacking the Facade of doing it for following the Sunnah of Noble Prophet (saw) is not only being guilty of Kufr, it's Fitnah. Islam is more nuanced than such shallow assessments.

The problem is your shallow assessment of Islam's penal code is not really Islam, it's merely a superficial assessment of it. Study Islamic Jurisprudence and it's standards then come back to us regarding the Penal Code.

By the way I want to emphasize, that this is not a refusal of the Islamic Penal Code, when it comes to capital crimes this is a critique against the misapplication of Islamic Penal Code.

Even in a hadith one man was being stoned to death but he managed to escape. Prophet Muhammad(saw) granted him severence on that account.

It's a command to look for reasons not to penalize someone if possible; therefore you're internally in contradiction to his commands by merely acting on the mode of penalty.

what is ridiculous is you not providing evidence to support your lousy claims when STONING was a prescribed practice not only of the israelites but also of our Prophet (SAW). yes, there is a process that exists in order to convict a suspected individual but if that results in proof of GUILT, there is no question that they will be dealt with according to the prescribed LAW. every muslim is equal under the shariah, and will recieve their due punishment as ordained by Allah (Swt) to mankind. Allah (swt) is the only One that can forgive sin.

the people who get worked up over the precribed punishment for fornication and adultery, etc. are most often ones who engage in criminal behavior themselves and thus try to make themselves feel less guilty. this is a known psychological phenomena.

if you disagree with the sunnah of Rasulullah (saw); you are free to choose a religion of your liking. islam does not need people claiming to be Muslim that corrupt and/or deny it's original teachings.

you accuse me of "kufr" yet my only crime in your eyes is that I uphold the clear sunnah of rasulullah (Saw). rasulullah (saw) said that whoever accuses a muslim of kufr, himself becomes a Kafir. (Bukhari)

with regards to crimes such as murder, thievery, etc. there is room for alternative compensation and leniency considering individual circumstances.

as far as adultery is concerned, when it is proven to have occured, the due punishment is a death sentence. what part of that is difficult to comprehend?

The child goes to the owner of the bed and the adulterer gets nothing but the stones (despair, i.e., to be stoned to death).” (Agreed upon. Al-Bukhaari 2053; Muslim, 1457. Al-Mughni by Ibn Qudaamah, vol. 7, p. 129)

Umar ibn al-Khattaab (may Allaah be pleased with him) said, when he was sitting on the minbar of the Messenger of Allaah (peace and blessings of Allaah be upon him): “Allaah sent Muhammad (peace and blessings of Allaah be upon him) with the truth, and revealed to him the Book. One of the things that He revealed was the verse of stoning, which we have read and understood. The Messenger of Allaah (peace and blessings of Allaah be upon him) carried out the punishment of stoning and we did so after him. I fear that as time goes by, people will say, ‘We do not find any mention of stoning in the Book of Allaah,’ so they will go astray by forsaking an obligation that was revealed by Allaah. In the Book of Allaah, stoning is the punishment deserved by any previously-married person, man or woman, who commits adultery, if proof is established, or pregnancy results, or he or she confesses.”

                          (Narrated by al-Bukhaari, 2462; Muslim, 1691)

‘Ubaadah ibn al-Saamit, who narrated that the Prophet (peace and blessings of Allaah be upon him) said: “Receive (teaching) from me. Allah has ordained a way for those (women). When an unmarried male commits adultery with an unmarried female (they should receive) one hundred lashes and banishment for one year. And in the case of a married male committing adultery with a married female, they shall receive one hundred lashes and be stoned to death.”

                          (Narrated by Muslim, 1690).

These punishments are too severe to be taken lightly. Did you know that the witnesses have to be great moral character to even have their testimony accepted as laid out by the criteria of "Tazkia Tush Shahood" and did you know that they must have seen the entire act from start to finish?

Islamic law has become a joke in our society. Anybody can claim to be wronged and buy 40 witnesses off the street for less than an Afghani. No one really cares for Shariah, badal/ghairath etc oppose the teachings of Islam. Killing on a whim for any reason is not permissable however much wrong may have been commited unless convicted by a true court.

You're comprehension here is clearly obtuse.

We're not denying the application of stoning, what we are denying is that this application was done without any assessment of nuanced features and whether it was advocated without any respects to possible reversion to clemency.

The Taliban understanding of Shari'ah is completely lacking of nuanced understanding and hence why they misapply Islamic rulings in such a negligent manner; on top of all their other stupidity like suicide bombings and obsessions over beard length.

The proof of this is how the Taliban shot this woman after after she survived the stoning. This is absurd, if she survived the stoning, she cannot be killed after that. This beyond the bounds.

This is not determining their guilt. If they were guilty and it was proved without a reasonable doubt that they were motivated by evil intentions; then by all means enact Allah(swt)'s law; but this is precisely why in respects to such acts Islamic Penal Code requires every stone to be uncovered in determining whether it is legitimate to be applied. Not every case is the same.

What youre doing is precisely why I'm calling out your arguments as fraudulent representations of Islam is because you're corrupting the actual nuanced assessments and details of Islam, especially in respects to how it applies it's penal code.

You accused me of Kufr, I'm merely reflecting your accusations based on a more detailed understanding of what Kufr represents. So please don't contradict yourself.

You know nothing about Islam except absurd Kharij doctrines.

This is not true, in Islam one merely needs to see the act of coition, not the "entire" act. There are also evidence that Forensic evidence can be administered as proof which fulfills the criteria of witnessing. With that said, other very specific and detailed set of instructions are required before stoning can be applied. For example , psych evaluations, motivations, state of mind etc etc etc. The intention is not to look for ways to stone people, but to purifiy society of the truly guilty and to help remediate and reform those who merely made a mistake.

However, depending on what degree of the act is being done, different levels of punishments are meted out, some punishments are Ta'zir, which is much less severely than Rajm (stoning), other acts like sexually erotic touching do not get stoning but are penalized is found guilty. This too must be evaluated by the above criteria.
