As alchemist has already stated the judicial needs the executive to enforce the laws. and the executive needs the judicial to interpret the laws. The branches have to cooperate and their allegence is to the constitution.

But in tribal societies, there is no real executive institution to enforce a decision. That is why there is constant warfare, the ultimate enforcer is "zor." The more "maroona" you have the more "zor" you have. The tribesmen code of badal is a balance to the party that uses "zor" wrongfully, even if it takes a hundred years, the wrongful party has to be punished.
