Okay, many here are calling it a CULTURAL PRACTICE.Some even said that Islam did not encourage it.

What is encouragement? Encouragment does not necessarily has to be advocating for some practice actively.Being a silent spectator is also encouragement in a way, since you lack the will to stop the practice at any point for a number of reasons that cater to your needs.

My question to all you respectable members was that if Sheen Khaloona are Haraam because Islam prohibits mutilation of the body, then why is there not any FATWAA against the genital mutilation of women? Because in principle, both are the SAME.

To those who say it is a cultural practice then let me ask you another question. If we can silently observe one CULTURAL PRACTICE (FGM) and do not declare it Haraam, why then another cultural practice of Pashtuns (sheen khaloona) becomes Haraam? Just because one orginated from Arabistan and the other from Aghanistan makes the entire difference!!!???

Yet another double standard!!!My hatred or love for a religion has nothing to do with my argument.I am basing my argument here on the principle. Both involve body mutilation--one in extreme form (FGM), the other in mild form. The mild form is haraam, whereas the extreme form is Halal????WHY??

Well, the Islamic scholars are divided on the issue. There are some who suppor the practice, and then there are those who despise it.

YouTube - Terror of Female Circumcision in Islam I

No mention of female circumcision is to be found in the Quran either directly or indirectly. There is no known Hadeeth which requires female circumcision. Some argued, however, that one Hadeeth, while not requiring female circumcision, appears to accept it:" Circumcision is a commendable act for men (Sunnah) and an honorable thing for women (Makromah)."5
There are two observations on this Hadeeth:
        • a) A distinction is made between male circumcision which is described in a stronger religious term (Sunnah)6 or commendable while another weaker description is given to female circumcision (Makromah) which implies no religious obligation.
          b) This Hadeeth is of weak authenticity (dha'eef) according to Hadeeth scholars.7
There is, however, a more authentic Hadeeth in which Prophet Muhammad (P) is reported to have passed by a woman performing circumcision on a young girl. He instructed the woman by saying:
        • "Cut off only the foreskin (outer fold of skin over the clitoris; the prepuce) but do not cut off deeply (i.e. the clitoris itself), for this is brighter for the face (of the girl) and more favorable with the husband."8
While the Prophet (P) did not explicitly ban this practice, his words project a great deal of sensitivity to the instinctive needs of females and their matrimonial happiness and legitimate enjoyment. Reference to the brightness of the face and to better relationship with the husband is clear indications of his sensitivity and compassion. They also stand in contrast to the arguments that female circumcision "controls" the woman's sexual appetite and hence contributes to sexual morality and virtue in society. It is true that Islam requires adherents of both genders to be chaste. Yet, there is no text in the Quran or Sunnah which requires selective curtailment or control of the sexual desire of one specific gender. Furthermore, chastity and virtue are not contingent on "cutting off" part of any sensitive and crucial human organ. Rather, they are contingent on spiritual and moral values of the person and the supporting virtuous environments.
Let me tell you that many muslim scholars who support FGM consider it pretty authentic, hence their support for the practice.
So my question is that if the practice is still not banned (by banning I mean despising the practice as much as terming it haraam), why are our SHEEN KHAAAL considered or can potentially qualify as Haraam? If the purpose of FGM is is to have a brighter face, then what's so wrong with the sheen khaal???

Yes, I brought the issue of FGM here because I want to preserve the beauty of my Pashtun culture. I also care for the women who become victims for this barbaric practice, but that is not the topic of discussion here.Saying that we don't support it, but still allowing it to happen, or more accurately, stopping it from happening when you have the power to do so, is pretty much the same in principle, if not in words.

        Peace.

Your culture does not tell you that you have mark your face permanently by tattooing your skin. You can use hennah to do that.

However, there are many things that muslims do which are not supported by quran & hadith. This is exactly why I do not follow any school. Because schools reject evidence sometimes or produce rulings without evidence.

Islam is not what mullah said or mullah does. Islam is quran, and sahih hadith. And if it is really necessary, reasoning by analogy. Like prohibiting smoking while no mentioning of cigarettes exists in quran or hadith.

You want to know why circumsion is not declared haram? Because it is a controversial matter and opinions are divided along different lines. Some argue that it has medical benefits. Others claim its sunnah. Therefore, it is unlikely to declare it haram. Because there is no concensus in support of such a ban.

Likewise there are many other issues that are very urgent matters. Just because feminists and kaafirs want demand something it doesn't mean Muslims should go ahead fullfil the wishes of disbelievers.

That is incorrect. A silent spectator means, "Okey, you can do it if there is a need for you to, but you dont HAVE to do it." Have you ever heard of choice? (Yes, if you'd only look into Islam you'd see there are alot of choices, if only!) Que, I thought you knew better than that, even quoting the four madhabs is not enough of a proof for you to prove something against Islam! Bring us evidence we can work on together!

Tattoo's are Haram because they are permanant and they have no purpose. They harm the body as well. There's nothing much to it You can not compare the two because tattoo's are not done for a specific reason! How absurd that you folk bring this up and leave the matter. You wanna talk about FGM, make another topic! Let's discuss tattoo's here and keep it at that, you can't bring in another example to prove this is correct in some twisted fashion

@ Shlombaya, I am sorry if I was a lil harsh to you I shall answer you fully inshallah, dont worry :D

Dukeminey, bear in mind that the silent spectators here are not you and me, but the "masharan of Islam" who has the power to stop the practice.Yet as of now August 15, 2010, the practice is still in operation due to the disagreement of Islamic scholars. All they need is to ban it.Why haven't they banned it yet? Well I don't mind whatever they do to their women, but I do mind when they come and tell us that our Sheen Khaals are haraam. I believe they should first set the example and stop being so hyprocrite.

FGMs in Muslim countries should also be declared haraam since they permanently leave deep scars on both the soul and body of the vitcim. They harm the body as well (there are no health benefits, but HARM http://www.who.int/mediacentre/factsheets/fs241/en/).
I think I have more reasons to compare them both in principle and practice. Both are cultural practices, both are used for beautification, both involve women, both happen in muslim countries (yes they also happen in some non-muslim countries too), both cater to the needs of men, both involve mutilation, one has been declared haraam , and the other has not been declared haraam. Looking at this, I don't think I am manipulating any facts/logic here. It's pretty straight forward to understand. .Bear in mind that I don't have to present anything in TWISTED FASHION since my argument is based on facts and rationale. And yes, I am not interested in opening the thread for FGM since obvioulsy truth is not what pleases us. Let us be in our persistent state of denial.
                Peace.

                  Question :
Are Tattoos Haram in Islam ? if not , which symbols are haram ? I know hurting the body on purpose is Haram , but if tattoo doesn't hurt the body , is it still Haram , can u please clear all that for me.

                  Answer :

                  Praise be to Allaah.

Tattooing, in which the skin is pierced with a needle and a blue or other coloured dye is injected, is haraam in all forms, whether it causes pain or not, because it involves changing the creation of Allaah, and because the Prophet (peace and blessings of Allaah be upon him) cursed the one who does tattoos and the one for whom that is done. In al-Saheehayn it is narrated that ‘Abd-Allaah ibn Mas’ood (may Allaah be pleased with him) said: “May Allaah curse the women who do tattoos and those for whom tattoos are done, those who pluck their eyebrows and those who file their teeth for the purpose of beautification and alter the creation of Allaah.” (al-Bukhaari, al-Libaas, 5587; Muslim, al-Libaas, 5538).

With regard to all these matters, the ahaadeeth testify that the one who does them is cursed and that they are major sins. There is some difference of scholarly opinion as to the reason why they are forbidden. It was said that it is because they are a form of deception, and it was said that it is because it is a way of changing the creation of Allaah, as Ibn Mas’ood said – which is more correct and also includes the first meaning. And it was suggested that what is forbidden is only that which is permanent, because that is changing the creation of Allaah; as for that which is not permanent, such as kohl which used for adornment by women, that is permitted by the scholars. (Tafseer al-Qurtubi, 5/393).

So if what is referred to in the question is that which is not permanent, then it is not a tattoo as such and does not change the creation of Allaah. See question no. 8904.

Female genital mutilation and the Koran

Answered by SunniPath Answer Service Team

                      Question:

Are female genital mutilation and honor killing 2 practices that are in any way advocated, condoned, or tolerated by Islam and the Koran?

                      Answer:

In the name of Allah Most Merciful Most Compassionate

I pray you are well and in the best of health and iman.

Absolutely not. As for female genital mutilation if the girl knew who did this to her, she could sue that person for damages even if it was after she had grown up.

As for honor killing, this must go through the courts, the Sacred Law doesn't give individuals the right to kill someone like this and if they do so, then they have committed a major sin and should be taken to court for it. And Allah alone gives success.

Why are tattoos filthy? How are they to be removed?

                          Answered by Shaykh Amjad Rasheed

                          Question:

I have read that tattoos are filthy. Why? How are they removed?

                          Answer:

Tattoos are considered filthy in our school and they prevent the validity of prayer. This is because tattooing--according to the explanation of the fuqaha--is extracting blood from the hand (for example) using a needle and then mixing a colored pigment with it that will mix with the blood and then dry so that its substance remains on the outer body.

Tattoos are prohibited (haram) and are obligatory to remove, unless one fears harm thereby, such as becoming sick, or delay in recovery from sickness. In such cases, it would not be obligatory to remove them.

As for how they are removed, this is a matter that returns to medicine, and there is no particular manner prescribed for it by the fuqaha.

                          Amjad Rasheed
