How could they move and how could they be undetected. It is impossible. there were 8,000 taliban fighters in the north during the 2001 US invasion and none could escape. They had to surrender. How could 10,000 uzbeks travel the country undetected. The militants in waziristan as well as helmand are overwhelmingly pashtun tribesmen.

My point isnt about Pashtun involvement in cross border attacks, its the fact, they are organised and led by NON PASHTUNS.

I think Soldat Amir meant the Abu Hanifa school of Islamic jurisprudence which is dominant in Afghanistan and which in brief takes into account the customary law, it means Pashtunwali (I know it is not the only one distinctive factor).

Do you know that until the end of the XIX a Muslim was required to belong to a particular Fiqh? Madrasah's at that time were divided into 4 parts (Hanafi, Maliki, Shafi'i and Hanbali's part) and a Muslim had to go to the part in accordance with his Fiqh.
