Pakistan breached 1974 agreement; did not take back stranded citizens: Bangladesh

Thousands of Urdu-speaking Muslims, dubbed as 'Biharis', who migrated to the former East Pakistan after partition in 1947, continued to stay in makeshift homes called Bihari camps

    May 14, 2016

Bangladesh today accused Pakistan of breaching the post-1971 liberation war agreement by not taking back thousands of its stranded citizens, affecting the validity of the treaty.

"Under the 1974 agreement (among Dhaka, new Delhi and Islamabad), Pakistan was obligated to take back its stranded citizens from Bangladesh. They did not fulfil their obligation over the decades," Law Minister Anisul Huq said at a discussion here.

He said, Bangladesh on the other hand, complied with the treaty allowing the defeated Pakistani soldiers' repatriation and in no way breached the agreement by bringing to justice Bangladeshi perpetrators of war crimes who carried out atrocities siding with the invading Pakistani troops.

He added that according to the principle of law, if any party violates a treaty, its validity comes into question while Pakistan itself "clearly defied" the agreement by refusing to take back its citizens over the decades.

Thousands of Urdu-speaking Muslims, dubbed as 'Biharis', who migrated to the former East Pakistan after partition in 1947, continued to stay in makeshift homes called Bihari camps in Bangladesh since 1971 and waited for decades to go to Pakistan but the subsequent governments in Islamabad declined to take them.

The law minister's comments came amid a growing diplomatic row between the two countries as Pakistan recently accused Bangladesh of failure to uphold the commitment of "not to proceed with the trials" in line with the 1974 treaty since Dhaka took initiatives to try the 1971 war criminals among its own nationals.

Pakistan had been upset after fundamentalist Jamaat-e- Islami chief Motiur Rahman Nizami was executed for war crimes in Bangladesh earlier this week and Pakistani parliament also passed a resolution condemning the hanging.

Bangladesh said Pakistan's reaction proved that Nizami was a "traitor" when he acted as chief of the infamous Al-Badr militia, an auxiliary unit of Pakistani troops that committed mass killings during the war.

Bangladesh had accused Pakistan of "deliberate misinterpretation" saying nowhere in the agreement was it mentioned that Dhaka could not try its own nationals who had committed war crimes and sided with Pakistani troops during the liberation war.

The two countries in the past week summoned and counter-summoned their envoys issuing statements and counter statements over Nizami's execution.

    1. After the 1971 war there were hundreds of thousands of ethnically Bengali citizens in West Pakistan. The then Pakistani leader, Bhutto used them as hostages and a bargaining chip to blackmail the newly independent Bangladeshi government to submit to certain demands.

Bangladesh succumbed to Bhutto's blackmails because they regarded those Bengalis in West Pakistan as their people and they were repatriated, maybe less than 1/2 a million of them.

However Pakistan should have done the same and repatriated those Pakistanis (or who identified themselves as Pakistanis e.g. Urdu-speaking Biharis) however the mainly Punjabi West Pakistani elite did not see these people as their people.

The mainly Punjabi military did see the 90,000 army personnel (mainly Punjabi) as their people, but not the darker skinned pro-Pakistan Biharis and thus unlike the Bengalis in West Pakistan who were able to go back to Bangladesh, the Biharis stayed in Bangladesh.

    2. Pakistan despite rhetoric and propaganda is primarily a state for Punjabi Muslim Sunnis.

Everyone else be they Pashtun, Bihari, Baloch, Bengali, Sindhi, Shia are inferior, and can be bombed, killed, discriminated against and use as disposable assets for the Punjabi Pakistani military.

This is what Jama't's founder Maududi says about Pakistan:

Role of Moulana Maudoodi: (Historical facts)

        IN THE WORDS OF MAUDOODI:

        1. “The establishment and birth of Pakistan is equivalent to the birth of a beast.”[Tarjumanul Quran vol.31, p.59, 1948 Pakistan]

        2. “Muhammad Ali Jinnah’s place is not on the throne of leadership. He deserves to face trial as a traitor.”[Tarjumanul Quran vol.31,p.62, 1948]

        3. "There were three actors in the partition of India. Muhammad Ali Jinnah’s performance proved to be most unsuccessful”.[Tarjumanul Quran vol.31,p.70, 1948]

        4. “It is haraam to vote for the Muslim League.” [Tarjumanul Quran vol.27, p.145, 1946, Pathankot]

        5. “Muhammad Ali Jinnah is the founder of fool’s paradise and an exceedingly sinful person.”[Tarjumanul Quran, Feb 1946, p.153]

        6. “Pakistan is a fool’s paradise and an infidel state of Muslims.”[Tarjumanul Quran, 1946, p.154]

        7. “Pakistan is filled with millions of robbers, thieves, murderers, adulterers and uncouth wrongdoers.”[Tarjumanul Quran vol.31, p.59]

        8. “An election campaign is a race of hounds.” [Kausar, 1950]

        9. “The Muslim League is an unrighteous and immoral party that has made our collective environment filthier than the lavatory.”[Jamaat Islami ki intikhabi jidd-o jehd, p.16]

        10. "The Mohajirs are deserters and cowards, who fought a national battle, but when the time came to pay the price, they took the path of escape.”[Nawa-e waqt, 29 Aug 1948]

Bangladesh recently executed the former leader of Jamaat e Islami in Bangladesh, the notorious Motiur Rahman Nizami. The Pakistani military and regime have gone beserk in trying to defend this criminal and his party.

Pakistan is supporting the Jamaat e Islami terrorist organization in Bangladesh even despite the fact that Jamaat e Islami campaigned against the creation of Pakistan, and were even banned by Pakistani governments themselves in the past.

The Jamaatis are now supported by the ISIS supporter and Turkish dictator, Erdogan.

Erdogan is supporting war criminals and terrorists in Bangladesh whilst Turkey has

        - 3 million refugees from the war in Syria.

        - economic war and sanctions with Russia.

        - Civil war in the south-east.

        - Terrorist attacks every month or two in important cities such as Istanbul and Ankara.

Erdogan is turning Turkey in to another Pakistan.

I believe these following Muslim countries will refuse to support any penalization of Bangladesh for taking action against Jamaati-Muslim Brotherhood related terrorists:

        - Egypt
        - Iraq
        - Algeria
        - Indonesia
        - Kazakhstan
        - Uzbekistan
        - Tajikistan
        - Malaysia
        - Morocco
        - Tunisia
        - Afghanistan

I think Egypt more than anyone else will support Bangladesh against any possible action taken against it by the Erdogan regime or the Pakistani regime.

Jamaatis supporting fellow Muslim militants in Egypt, the "Muslim" Brotherhood.

An anti-Saudi image from the Jamaati facebook page, Basherkella.

The Jamaat e Islami rank and file in Bangladesh are anti-Saudi and pro-Iran.

This is despite Saudi providing them with valuable support for decades.

          War criminal Nizami.

Erdogan has been supporting Islamic extremists through out the globe including ISIS in Syria, however things are getting more and more difficult for him.

Davutoglu, who was also vocal in his support for terrorists and war criminals in Bangladesh, is being booted out of office - as prime minister - by Erdogan, even though Erdogan as ceremonial president is not legally entitled to do so.

Humiliated, supporter of the Jamaat e Islami terrorist organization and war criminals in Bangladesh, Davutoglu is now being removed from office by Erdogan despite being the democratically elected prime minister of Turkey. Turkish Islamists are now fighting each other.

Turkey despite having a civil war in its south-east with a helicopter downed today by PKK fighters is looking for trouble and conflict with Bangladesh, after having sought trouble with Russia, Syria, Israel, Egypt, Tunisia, Libya, Germany and many others.

            Correct.

There are 4 provinces in Pakistan, 3 other than Punjab.

Why is it Biharis were only good enough to live in Sindh and not in Punjab?

Were they not "Muslims" or Pakistanis?

As I said Pakistan is a state for Punjabi Muslims with non-Punjabis as second-class citizens, Pakistan's refusal to allow Biharis to live in Punjab just proves they did not consider Biharis as Pakistanis or as the same people.

Do you blame them? Half of sindh population is already non-sindhi in the name of Islam, sindhis are small minorty in their own cities and you want them to take millions more? Biharis are good and honest people, I'm sure they will do well in Bangladesh.

We have to clean Karachi from illegal afghani, bengali etc muhajirs to make Sindhi people happy. Otherwise only Islamabad will remain part of Pakistan.

Interesting you mention Afghans, Bengalis and Muhajirs but don't mention Punjabis.

If you want to ethnically cleanse Sindh of non-Sindhis then that would include Punjabis.

However I doubt that would happen as Pakistan is a Punjabi-ruled country, run for the interests of the Punjabis and other races are subjugated.

Are those Urdu-speaking Biharis that were in east Pakistan before and after 1971 Pakistanis?

If they are Pakistanis do they not have the right to live in any part of Pakistan?

Biharis were east Pakistanis just like bengalis before 71, now they are citizens of Bangladesh.

We native people of Pakistan already suffered enough in the name of Islam by bringing in countless muhajirs after 1947, not anymore. If retards in Islamabad decide to bring them to Pakistan then I swear soon only Islamabad will remain Islamic republic of Pakistan.

Did you "suffer" from Urdu-speaking Muhajirs or do Punjabi-speaking Muhajirs like General Zia from India also count?

Actually some biharis were re-settled in mian channu in punjab in the early 1990s but even that scheme got wounded up because once in pakistan they started going south to join their relatives already living in karachi.

Read your link which I'm quoting below. No reference to those few hundred Pakistanis "going south" to relatives in Karachi.

                              It does say this though:

But successive Pakistani governments have shied away from repatriating the Biharis. Many Pakistanis fear the influx of Biharis will add to the ethnic tension that already exists in Pakistan, where five major ethnic groups seek equal status.
The fact is we Bengalis saw the Bengalis stuck in West Pakistan in 1971 as our people and brought them back home.

You Pakistanis did not see the Pakistani-Biharis as your people and left them in Bangladesh. You have disowned them, whilst we supported our people.

Seeing them as non-Pakistanis is confirmed by [MENTION=19473]Golden[/MENTION] 's comments.
