Legalities in war only matter when you are the dominant party, able to inforce those laws. This is exactly the problem with Geneva Conventions and series of sham laws that were promulgated as some sort of general idea of an honor rule between nations. The folks that design these international laws know full well that once blood is split, it continues to flow unabated. This is not a game of soccer where red cards are handed out.
Thats been my point to folks here at Yale regarding the Arab Israeli conflict and in terms of discussions centering around the durand line. Even if you were to definitively show one party, by building a machine, and clearly demonstrating their errors... if they are in a dominant position they will never cede that position unless the gain for them is some semblance of confirmed stability or the pot is made sweeter.
Its been a favorite quote of some colleagues here in New Haven when this discussion comes up: "But Karzai is the internationally recognized leader of Afghanistan!"
Autonomous nations are able to exorcise their writ. When I was a child, there was an American student who did some hokey pokey in Singapore:

There was a huge uproar about how dare Singapore inflict lashing onto an American visitor for breaking Singapore's law. It did not matter though, because as weak as Singapore may be, it still is an autonomous nation, able to exercise its writ in its own nation.
Unforunately Mr. Karzai believes, like a giddy teenage girl at prom who thinks she is Cinderella, that he actually is Hamid Shah Durrani turban and all. As time has gone by, and as he has realized that he is being cut out of the deals being made... and as he saw Gaddafi's fate (collaborator), Saddam's fate (collaborator), Ben Ali's fate (collaborator), he himself supposedly said... should I be Wazir Akbar or Shah Shuja??? He doesnt understand that you cannot dance with the devil in the pale moon light and not get a little smell of sulfur on you.
Same goes for the US dancing the tango with inept autocrats like the above mentioned... no matter what the intentions of the liberal interventionalists are... they dont understand they dilute their goals by dancing with the Karzais.

such a sad day!!
