quran does explain most of it. but zina is a consensual act.but when there is force , drugs or threat involved its considered a more severe crime.
excellent.

I am not so sure whether I am posting this in the right section, but I wouldn't know where else to post it. Anyway, I am a law student from the Netherlands. I opened this thread because I am in need of some help. I am looking for a verdict of Judge Michael Stokes QC. In this case he ruled on the 'grooming' and rape of a minor by a man named Adil Rashid. What is interesting in this case is that the defendant claimed his 'Muslim' upbringing as a reason for not knowing that rape is illegal (obviously doesn't make any sense, but that's a different discussion). I read about this case on several websites, but simply cannot find the court verdict. I do have the following information:

Judge: Michael Stokes
Defending barrister: Julia Smart (initially) and later on Laban Leake
Defendant: Adil Rashid

One of the websites I read about this case was on LiveLeak.com - Paedophile who groomed victim on Facebook claimed his Muslim upbringing meant 'he didn't know it was illegal to have sex with 13-year-old girl

Have any of you heard about this case? Is it perhaps fake (because 99,9% of the websites I found this story on were anti-muslim websites)? I would really appreciate it if a law student from the UK could help me find this verdict, if it exists.

Thank you very much in advance!
wether its true or not, this article is mocking both the justice system and islam. there is no excuse for young man to having sexual relations with a minor. what he is saying that he was seduced by a 13 yo girl. in madarsa he was allowed to used a computer and allowed to go on Facebook and other social networks, but did not know having sex with a minor. he should stuck to his story who knows this might be the best excuse.LOL

go and make own thread and fight there about different topics
the guy is using islam as his excuse and blaming all of it on his religious knowledge of islam. if islam punishes these kinda criminals how come he is using islam as his excuse. I am sure the person was born and raised in a western society, how come his parents didn't get in trouble not sending him to a school? what kinda madrasa is that the government isn't aware of? i believe this is just a propaganda.

Hoi.

Badlun
Thank you for your response! My personal view of sexual relations with a minor is reflected in the legislature of all Western countries: I think it should be banned. The paper I am writing however will not discuss my personal opinion. It has to focus on the validity (from the perspective of Dutch or European law) of the so called 'cultural defense' (I didn't know because I am bla bla), as is used by the defendant in the verdict that I am looking for. Whether Islam permits it or bans it is thus not what I will be discussing. Nor is it, to be very honest with you, something that interests me.

Большое спасибо тебе! Я уже написал е-майл в суд. Надеюсь что они мне ответят скоро.

I completely agree with you that the young man in question had no excuses whatsoever. Also, his decision to have pre-marital sex is contrary to Islam, so his defense doesn't make any sense. This is also something that the judge remarked during the trial. He is quite obviously simply using his upbringing as an excuse. The case however is real (and so is the defense), no doubt about it. I decided to verify the info I found on the net, so I ringed the Court House. An employee of the of the Nottingham Crown Court confirmed the information I had.

I have studied law thats why I do not mix religion and law everywhere. Religion has role in law in some countries especially in family matters but the religion including Islam never provide legal codes and legislation is always done by parliaments/governments not by God or prophets.

For example in the following verse of the Quran we have to see the context(Jews problems with prophet) as well as its other implications.

“The punishment of those who wage war against Allah and His Messenger, and strive with might and main for mischief through the land is: execution or crucifixion or the cutting off of hands and feet from opposite sides or exile from the land: that is their disgrace in this world and a heavy punishment is theirs in the Hereafter.” [Sûrah al-Mâ’idah: 33]

This verse is not especially for rape. Rape is a distinctive crime and you cannot punish every accused of rape by either execution or crucifixion or cutting off of hands and feet or exile. Rape is not waging war or mischief through land. Rape is a crime where two human beings are involved not God, prophet or mischief through the land.

Normal zina with consent is not a crime because how can you blame two persons if both the adults agree to do something. If you force then it becomes a crime or if it is with a minor because the minor is still not legally a mature person to give or receive consent. Quran being a religious book mentions zina but my interpretation is that zina mentioned in Quran can only be rape not sexual relations with mutual consent.

Religion morally discourages crimes but Quran is not a book of law or a legal code because law and legal cases are very complicated. You cannot codify crimes and punishments just by two sentences.

"O ye who believe! Obey God, and obey the Apostle, and those charged with authority among you. If ye differ in anything among yourselves, refer it to God and His Apostle, if ye do believe in God and the Last Day: That is best, and most suitable for final determination. (The Noble Quran, 4:59)"

"When there comes to them some matter touching (Public) safety or fear, they divulge it. If they had only referred it to the Apostle, or to those charged with authority among them, the proper investigators would have Tested it from them (direct). Were it not for the Grace and Mercy of God unto you, all but a few of you would have fallen into the clutches of Satan. (The Noble Quran, 4:83)"

how Prophet Muhammad peace be upon him dealt with the rapists:

Narrated Wa'il ibn Hujr:

"When a woman went out in the time of the Prophet (peace_be_upon_him) for prayer, a man attacked her and overpowered (raped) her. She shouted and he went off, and when a man came by, she said: That (man) did such and such to me. And when a company of the Emigrants came by, she said: That man did such and such to me. They went and seized the man whom they thought had had intercourse with her and brought him to her.

She said: Yes, this is he. Then they brought him to the Apostle of Allah (peace_be_upon_him). When he (the Prophet) was about to pass sentence, the man who (actually) had assaulted her stood up and said: Apostle of Allah, I am the man who did it to her.

He (the Prophet) said to the woman: Go away, for Allah has forgiven you. And about the man who had intercourse with her, he said: Stone him to death.

He also said: He has repented to such an extent that if the people of Medina had repented similarly, it would have been accepted from them. (Sunan Abu Dawud, Book 38, Number 4366)"
quran won't go into such details whats considered rape in modern times. but still there are laws of the land which should apply in this case especially for the young man had committed a crime.
i am not a scholar, but quran doesn't go into details of many sexual acts. in islam you cannot even punish some one for zina unless penetration has taken place.
