  • UK law students, please help me!

    Dear fellow Pashtuns,

I am not so sure whether I am posting this in the right section, but I wouldn't know where else to post it. Anyway, I am a law student from the Netherlands. I opened this thread because I am in need of some help. I am looking for a verdict of Judge Michael Stokes QC. In this case he ruled on the 'grooming' and rape of a minor by a man named Adil Rashid. What is interesting in this case is that the defendant claimed his 'Muslim' upbringing as a reason for not knowing that rape is illegal (obviously doesn't make any sense, but that's a different discussion). I read about this case on several websites, but simply cannot find the court verdict. I do have the following information:

    Judge: Michael Stokes
Defending barrister: Julia Smart (initially) and later on Laban Leake
    Defendant: Adil Rashid

One of the websites I read about this case was on LiveLeak.com - Paedophile who groomed victim on Facebook claimed his Muslim upbringing meant 'he didn't know it was illegal to have sex with 13-year-old girl

Have any of you heard about this case? Is it perhaps fake (because 99,9% of the websites I found this story on were anti-muslim websites)? I would really appreciate it if a law student from the UK could help me find this verdict, if it exists.

Thank you very much in advance!

Thank you for your help! However I have looked on various case law search engines (bailie, westlaw, the law pages, ets) but I have found nothing. I can only find endless amounts of news paper articles. It is making me go absolutely mad! So frustrating

I know that the Nottingham Crown Court issued a verdict in this case. And I'm pretty sure they issued it on January 25th 2013. Surely there must be other law students (preferably from the UK) here?

It is so much easier to find case law in the Netherlands, pffff...

i am not a law student but if you even know the date that the verdict has been issued then why don't you go to the public library and pull out the bloody newspapers for that day or that week?? as biased as they might be, i am sure they would publish the facts and not the rumors.
you are a law student so chances are that you will be needing this kind of information more often. this is a pretty recent case so all you have to do is go down to the courthouse and ask someone at the desk to look it up for you or direct you to where they keep the records. every ordinary citizen has the right to have access to those files. you are meant to do research. surely they don't expect you to come across this knowledge in a dream.

I live in the Netherlands, so going to the courthouse is not an option. And only one relatively decent Dutch newspaper has reported on this verdict. Anyway, when writing legal pieces we always need to refer to the original verdict and not newspaper reports on the verdict (maybe it's different in other countries, I don't know).

I have ringed the courthouse however, and they gave me an email I could mail my question to. Hopefully that will bring me a bit closer to obtaining a copy of the judgement.

But thank you for your suggestions.

I have studied law as a minor subject and you may find details of the particular case in reference but you can also share here your own approach on the subject of sex with minor and rape.

I have never seen any verdict or injunction on rape in any legal text book of the so called Islamic jurisprudence. What they mention is Zina(fornication and adultery) but never rape. Similar silence is found in the original sources on sodomy and lesbian sex(homosexuality).

Sex with minor is considered a norm and even some call it an act of virtue because it is sunna(tradition of the prophet) because of his marriage with a 9 years old Ayesha.

rape would fall in the hideous crime category. rape is using force and violence. I hope you realize it is not the same as zina.

Yes this is the point. I know that normal zina is not rape and my astonishment is on the silence on rape, homosexuality and sex or marriage with minors in the original sources of the so called islamic jurisprudence.

I call it so called because for me Islam touches these things from moral point of view not from legal point of view.

there are injuctions on violent crime in Islam and its punishments are outlined.

Are you of the belief that rape is not a violent crime?

“The punishment of those who wage war against Allah and His Messenger, and strive with might and main for mischief through the land is: execution or crucifixion or the cutting off of hands and feet from opposite sides or exile from the land: that is their disgrace in this world and a heavy punishment is theirs in the Hereafter.” [Sûrah al-Mâ’idah: 33]

quran does explain most of it. but zina is a consensual act.but when there is force , drugs or threat involved its considered a more severe crime.
