Samsung Galaxy Tab 10.1 sales banned by US court

Apple and Samsung have accused each other of copying aspects of their devices

A court has banned sales of Samsung's Galaxy Tab 10.1 tablet in the US while it decides on the firm's patent dispute with Apple.
Apple has claimed that Samsung infringed its design patent and copied the look of its popular device, the iPad.
The Samsung tablet is considered by most analysts as the biggest rival to Apple's iPad.
The ban does not apply to the Galaxy Tab 10.1 II, the tablet's new edition.
The trial for the case is scheduled to begin in California on 30 July.
"Although Samsung has a right to compete, it does not have a right to compete unfairly, by flooding the market with infringing products," said US District Judge Lucy Koh.
In an emailed statement to the BBC, Samsung said that it "will take necessary legal steps" and that the ruling was unlikely to have a significant impact on its business.
'Extraordinary' Apple and Samsung are two of the biggest manufacturers of tablet PCs and smartphones.
The two rivals are involved in a variety of legal cases in various countries across the globe amid claims and counter claims of patent infringement.
While Apple had accused Samsung of copying its design and look, the South Korean firm has alleged that Apple infringed its patents relating to the way phones and tablet PCs connect to the internet.
Analysts said the order passed by the judge was a significant development in the continuing legal battle between the two companies.
"The relief being given to Apple here is extraordinary," said Colleen Chien, a professor at Santa Clara Law in Silicon Valley.
"Preliminary injunctions are rarely asked for and rarely granted."

Apple sounds so pathetic! I mean, would DELL sue COMPAQ for copying it's design?

Apple can't innovate for the whole world. The Chinese(not all) need to get their lazy butts in the research labs to perform experiments like the 1.2 million American scientists.

The men of Kábul and Khilj also went home; and whenever they were questioned about the Musulmáns of the Kohistán (the mountains), and how matters stood there, they said, "Don't call it Kohistán, but Afghánistán; for there is nothing there but Afgháns and disturbances." Thus it is clear that for this reason the people of the country call their home in their own language Afghánistán, and themselves Afgháns. The people of India call them Patán; but the reason for this is not known. But it occurs to me, that when, under the rule of Muhammadan sovereigns, Musulmáns first came to the city of Patná, and dwelt there, the people of India (for that reason) called them Patáns—but God knows!

I understand that Apple want intellectual copyright on their property but technologies surpass boundares and people will replicate or build on innovation. That's a key strength of the Internet and open source technologies. Apple is purely protecting it's business interests which is understandable but you cannot realistically claim that everything is your own invention and ring fence it. Even Microsoft began to realise this when it started to offer bundles and packages.

I use Apple regularly and I like their innovations but I much prefer the freedoms offered by Android and devices like Raspberry Pi.

I, myself, use and prefer Android. However, I completely understand where Apple is coming from. When Apple innovates and releases a product, it expects a tad-bit of respect from it's competitors. Respect in the form of, go hit your labs, hire your Korean engineers, and try to compete with us. Don't just blatantly copy us.

When Samsung goes ahead and releases a product that looks like this:

It's really hard for Apple, that has spent millions in R&D to just sit back and let someone walk away with that. There are decades that are invested in research. Which is why Apple products are far more polished, and furnished as opposed to it's competitors.

With that being said, I agree that Apple has a problem with claiming everything as their own(think slide-to-unlock)but they do have a point when they say we can't innovate for the whole world. In fact, it would be interesting to know that Andy Rubin, the chief 'innovator' of Android was an employee at Apple. So it's fair to assume that this Apple employee, who later started his Android Platform with his buddies, was inspired during his brief stay at Apple(although this is impossible to prove).

samsung might sound like its getting treated bad but really from what I've heard their work environment is pretty much based around copy the hell out of everything..Its just that they've never been hit really hard by anyone which is why this is a surprise.
