  • Swiss Muslim girls must learn to swim with boys, court rules

Switzerland has won a case at the European Court of Human Rights (ECHR) obliging Muslim parents to send their children to mixed swimming lessons.
It said authorities were justified in giving precedence to enforcing "the full school curriculum" and the children's "successful integration" into society.
The ECHR acknowledged that religious freedom was being interfered with.
But judges said it did not amount to a violation.
The case was brought by two Swiss nationals, of Turkish origin, who refused to send their teenage daughters to the compulsory mixed lessons in the city of Basel.
Education officials, however, said that exemptions were available only for girls who had reached the age of puberty - which the girls had not reached at the time.
In 2010, after a long-running dispute, the parents were ordered to pay a combined fine of 1,400 Swiss Francs ($1,380, £1,136) "for acting in breach of their parental duty".
They argued that such treatment was a violation of article nine of the European Convention on Human Rights, which covers the right to freedom of thought, conscience and religion.
Image copyright Getty Images Image caption The controversial case was decided on at the European Court of Human Rights In a statement, the ECHR said the refusal to exempt the girls had interfered with the right to freedom of religion.
But it also said the law involved was designed to "protect foreign pupils from any form of social exclusion" and Switzerland was free to design its education system according to its own needs and traditions.
Schools, it said, played an important role in social integration, and exemptions from some lessons are "justified only in very exceptional circumstances".
    Swimming, burkinis, and integration

    • In 2016, officials in Basel suspended the citizenship process for the family of two teenage Muslim brothers who refused to shake hands with female teachers.
    • Switzerland has also applied the law to other cases - a man of Bosnian origin was fined last year for refusing to allow his daughter to take part in swimming lessons during school hours, among other activities.
    • Germany also battled with the issue of mixed swimming lessons in 2013, when a judge ruled that a 13-year-old girl must attend - but allowed the wearing of a burkini.
    • In France, in 2009, a woman was banned from swimming in a public pool in her burkini. That would be followed in 2016 by a controversial official ban on the garment in public spaces - which was eventually overturned by French courts.
    • France, Belgium, and the Netherlands all have bans on Muslim veils in public, to varying degrees.

"Accordingly, the children's interest in a full education, thus facilitating their successful social integration according to local customs and mores, prevailed over the parents' wish to have their children exempted from mixed swimming lessons," the court said.
The court also noted that "very flexible arrangements" had been offered as a compromise, including allowing the girls to wear burkinis during lessons rather than traditional swimwear, and allowing them to change clothes with no boys in the room.

They are children. School boards don't have money to make segregated sections designated for swimming because you don't want your female child swimming in the same swimming pool as some other child and I don't blame them. If you are so against the idea, go to a private school where such things are made possible by generous donations or heavey fees coming out of your own wallets.

They are children. Children need to socialize in an environment where people if the opposite genders exist. The **** sort of children are you people raising??go isolate yourselves behind some rock. Damn.

How much money does it take to have a session for boys and session for girls. It's not like they need to make a whole new damn swimming pool. They have girls and boys restrooms. It's not hard to schedule girls and boys swimming sessions. Goodness, get a clue Miss Piggy.

Also, as economist Kaushik Basu says: "For a nation to progress it is important for people to spend time on science, mathematics and literature instead of spending time showing that 5,000 years ago their ancestors did science, mathematics and literature."

They are not children...but teenagers....at this Stage they are well aware of immoral behavior, specially boys....

IT depends on how you want to raise your daughters... Want them to be morally loose like Western women? Sleep with One man One might, and another man another might? By the time an avarage Western woman is 20 years, she has slept with men Double amount her Age...

This is the norm...and these children are learning this behavior is acceptable at this stage. In thei schooling system...

13 year olds are not so currupted that they would behaving immorally at the sight of someone of the opposite gender in the presence of 20 other students as well as their teachers and lifeguards. I am not saying let them socialize in a room alone. If you raise your child properly, regardless of the time or place, they will know immoral behaviour when they come across it. But if you are someone who expects that from them and assumes that's what they do if they are put with 20 other kids of their own age and adults to supervise them, then you are not too fit to be in charge of raising kids and who knows what your kid might be up to, to begin with.
I believe in holding kids in high esteem and respecting them. If you show them that they are respected, they will respect you in return and never want to disappoint you. There is no resentment in between, bo communication barriers and all for the sake of love, not intimidation.

I am not telling anyone to leave their child unattended with someone of the opposite gender, nor am I suggesting that they should be taught immoral behaviour. Don't assume your child will do wrong just because they are not 5 anymore.

I have to admit though, when I started this argument, I did not know that the "children" in question were 13 year olds. That may work for me but I don't expect that to work for other Muslim or Afghan parents. In which case, I would just take them somewhere else for swimming instead of wasting my time by forcing non Muslim or afghans to change their entire system to fit my needs.
But even with 13 year olds, if you don't consider them children anymore then you should respect them according to the behaviour you expect from them.

anyone could have said that, including white people, the blacks or browns who don't mind having their kids being a part of this program in the west.. they could say they don't mind you wanting whatever you want for your child, as long as you don't try to impose those rules on them or their kids. where would you go with your problem then??

you can make a point or you can find a solution for your problem. if you want to make a point and are not too interested in a solution, you can go through the trouble of filing a case, knowing your chances of winning are pretty much zero, wasting your time and then ending up with what happened here. that option is not in your child's best interest but it serves your ego plenty.

if you want an option that is less time consuming, in your child's interest and has better chances of succeeding, you can just find a school or program that is compatible with what you want for your child and call is a day.

muslims tend to put so much effort in to such garbage ideas. if you all used that effort towards something that you knew for a fact was giving you better results, we wouldn't be suffering to the extent that we are out there.

The point is, most muslim countries have utter disrespect for non muslims and what they do, most non muslims are not even allowed to practice their faith properly and they are oppressed by the muslim majority, In fact in a way the (puppet) governments of the muslim world are better for the non muslims, because or else the muslim public will kill off every trace of non muslims from their lands. In the western world, muslims are given full rights to anything they want. Like I said, you guys lucky to express your opinions in the west, you wont get the same freedom in your countries

which countries? only the gulf, and that is too because the royals have invited them there for work. Do you really think if Muslim public had power, they would allow non muslims to exist there? Look at how every trace of non muslims has been wiped out in Afghanistan, Saudi Arabia and so many other muslim countries. If muslim public has power, then ISIS happens, it is simple as that
