It’s ok to surrender wife to rapist, Egyptian Cleric says in fatwa

An Egyptian preacher has issued a fatwa – an Islamic legal opinion – according to which rape is like robbery and a husband should not risk his life protecting his wife’s honor from another man.

Yasser Burhami, the vice president of Salafist Call, the religious arm of the political ultra-conservative Nour party, has compared a rape with a robbery, saying that nobody should put their live in danger for money.

“In this case he [husband] is forced [to surrender her] and not obliged [to defend her],”Al Arabiya quoted the cleric as saying in his fatwa.

Burhami’s remarks, published on Anasalafy.com have been widely condemned by other clerics and activists in Egypt.

“Every Muslim has to protect his honor even if that leads him to jail or death. The sacrifice to protect a wife'shonour is a religious obligation,” Assaeed Mohammad Ali, an official at Cairo's religious endowments ministry told the al-Masry al-Youm daily.

Sheikh Ali Abu al-Hasan, the former head of al-Azhar’s fatwa committee, said that this fatwa was “baseless in the Islamic Sharia” and that protecting a female honor is an obligation for her husbands and her relatives, Al Alrabiya quotes.

In a rebuttal, Salfist Call defended their cleric, saying that he only meant there was no “obligation of defending the [wife’s] honor.”

“But if the husband is certain that he is not capable of defending himself, that he will die and that the honor of his wife will be jeopardized, what can he do?” said Sheikh Ali Hatem, a Salafist Call party spokesman.

"He is allowed to choose between sacrificing the honor and protecting his life."

On Thursday, Egypt’s religious endowments ministry banned Burhami from preaching in any of Egypt's mosques, saying that he is not an al-Azhar graduate, Egypt's Islamic Research Academy.

The man is right and the people slandering him will have to answer for their deeds in the day of Judgment.

It's not the husband's business to avenge his wife.

In an Islamic state, the rapist is punished according to Sharia law, after a trial and proven guilty, he is executed.

There is currently no Islamic state in the muslim world, hence why honor killings conducted by primitive uncivilized savages who follow pagan principles happen all the time in the middle east.

... Is every Muslim expected to hold their cool, wait for the state apparatus to track the perpetrator down and have the whole matter replayed over during a Shariah compliant trial?

Fine if you have the patience, but quite a few of us would not hesitate in picking up a hard object if that was one of our daughters. I don't advocate vigilantism but like it or not, humans can have very emotional responses to that kind of crime.

Yes, this is the difference between civilized societies and mob rule.

If you want Afghanistan (or any other country for that matter) to prosper, you must start by rejecting pagan principles and implementing Islam.

Either you follow Sharia law, the divine principles, and your country will flourish by the grace of Allah Most High.

Or you continue with your pagan principles from the Pashtunwali (or the Kurdish honor code, or the Chechen honor code, or the Turkish honor code...), and acid attacks, women forced to marry rapists or murdered because of rape, endless tribal wars... will always be seen as a part of your culture and identity.

In Islam, the hijab is compulsory and honor killings are forbidden.

Apostates pretend that the hijab is not obligatory and disbelievers pretend that honor killings are part of Islam.

They all have an agenda to destroy Islam.

        The truth is clear though.

          1. RT, Russia Today is a Moscow mouth piece.

Moscow does not like Salafis for a number of reasons including their involvement in the insurgencies in the Caucasus.

          2. This is selective targeting of the Salafis (not that I like them).

Will the Catholic church say you must be prepared to die to stop your wife from raping (may Allah prevent any of us from ever being in that situation, ameen)?

What would other "religious" figures say?

because justifying raping women when they are involved themselves is too much of an obvious thing to do. And then they claim women are not treated like property or objects..
This is why you need to take a stand for yourself in life and not depend on what others tell you is right or wrong. Worst things have even suggested and acted upon by so called religious leaders..

"To burn always with this hard gemlike flame, to maintain this ecstasy, is success in life."

if this is true, then it is really _ucked up thinking by this man. These people play in the hands of Islamic haters by giving these stupid fatwas which make no sense

Also Al hanif, you are saying that you will not save your wife if she is being raped?

I don't think the Salafi is saying "if it happens, stand and do nothing".

I think what he was saying is that if the man might die he should not risk his life.

Another way would be if a woman was to see her husband being beaten up (even raped), she herself should not try and save him if it ends up in her dying.

It is worse that out of the two spouses that one is dead, as opposed to one being raped/beaten but both still alive at the end.

Anyway I don't really like Salafis but this is just "western" (RT is Russian but the religio-cultural context its reporters are coming from is a western Judaeo-Christian one) targeting of the Salafis and Muslims in general.

*Even here in the west they teach security guards, bus drivers not to risk their physical safety (let alone lives) if there is a risk thugs might attack them. So I am sure western religious figures would extend the same line of thinking to rape.

Anyway rape is something absolutely disgusting and should be totally rejected and not trivialized in any way.

You maybe right, it could be propaganda

However the argument (the man might die) doesn't make sense. If your wife, children, mother etc... is being raped/beaten, then it is natural for a man to try his best to save them in that situation. Only the biggest coward of a man will think about dying in that situation and not worry about their family members being assaulted/killed

If a bunch of thugs grab the man and put a gun against his head, and then do the evil action we are talking about (I don't even want to mention it, as I am a religious person and I know sometimes if you speak of bad things in a light or trivial manner they can them come and happen to you) to his wife, there is not much he can do, or much she can do if the roles are reversed.

If one of the couple ends up dying the children are left without a father/mother for the rest of their lives.

If one of the couple is raped/tortured they are still alive to look after their children and the children might not know of it.

However you are right short of dying everyone should do their utmost to save their loved ones in such a situation and I know many people who would just be dominated by emotion and do anything to save them and be totally indifferent to "rational thinking" at that time.

May Allah protect women and everyone from the evil of rape.

                    Ameen, thumma Ameen.

hahaha... Badlun and toramana type should appreciate this guy...
Shame on him not having islamic sharia in his own country and issuing such fatwas which hasno relevance to the current problems of the Muslims. By the way he should also have issued some fatwa against egyptian army for over throwing the legitimate govt of morsi.
