An Al-Qaeda-linked group has issued new decrees restricting the personal freedoms of the Syrians in the areas under its control in Raqqa province. New laws prohibit music and smoking cigarettes and shisha. Violators will be “punished by sharia law.”
The Islamic State in Iraq and the Levant (abbreviated as ISIS or ISIL) has issued four statements that decree new laws on Monday. The new laws come into force three days later, the group said, i.e. January 23.
Starting on that day, women are obliged to wear the niqab, or full face veil, and cover their hands with gloves. They will also not be allowed in public without a male guardian. Walking late at night will also be prohibited for the women of Raqqa, the first and only city to have fallen completely under the jihadist group’s control.
“Any sister who does not comply with this moral code will be punished by the rules of sharia, her male guardian will also be punished,” reads the statement, cited by the Syrian Observatory of Human rights.
In its second statement, the jihadist group has also prohibited music from being played in public and photographs of people being posted in shop windows.
It has also declared selling music CDs or musical instruments illegal, and the playing of scandalous music in cars or shops will be strictly forbidden.
The ISIL has explained the ban saying that musical instruments and singing are “proscribed in Islam because they distract from remembering God and the Quran.”
The sale of cigarettes and shisha water pipes has also been banned across the beleaguered province.
“Whoever insists on selling these products will have the quantity in his possession burnt and will be punished under sharia law,” reads the third statement.
The group demands that all shop owners shut their stores 10 minutes prior to calls to prayers and absolutely all men must head to the mosque and “fulfill God's commandment rather than sitting in the street and talking while Muslims are in their mosques.”
“Whoever is found outside at the time of prayer” will be punished.
The Islamic State of Iraq and the Levant retook full control of the Syrian city of Raqqa, after fierce fighting for the northern provincial capital on January 14. Clashes between ISIL and coalitions of rival Islamist and moderate rebels erupted nearly two weeks ago.
The group is holding hundreds of rival rebels, activists and journalists captive, among them Westerners, the Syrian Observatory for Human Rights said last week.
In its report in December, Amnesty International accused an Al-Qaeda-linked jihadist group of abductions, torture, killings, sharia courts, and secret prisons with “inhuman” conditions. The report revealed victims included children as young as eight.

That being said ISIL is literally copying the 90's Taliban. How good did they do? Banning all those things will only make people wanna do them alil more.

How do you punish somebody for smoking cigs, according to Shariah?

How and why do you punish a female for not wearing a walking blanket, and why does a male guardian get punish as well?

These people are literally stupid and making up rules. All they do is punish and punish. Where's the smiles and happiness which should come when a city is ruled with Shariah?

All they did so far is ban this ban that, punish this, punish that.

these men are fools, this new group has to prove its own worth to the people more than the people do to them. if the people are to live under this system, the people administering the law must prove its ability to govern the people and not just take government positions and introduce these laws all of the sudden.
There are people today who think that admitting God’s absolute greatness decreases the value and importance of humans in the creation, as if God and mankind are rivals competing in greatness and power. Meanwhile I feel that whenever our perception of God’s greatness increases, with it we become greater, because we are the creation of a great God.

I asked my teacher about this issue, because there are clear athar and stories that the sahaba never used to apply the hudood in a state of war. My teacher said that the people in their are most likely pretty sure they have total control of the areas and in such cases the hudood is applied.

So Ta'zeer is just applying penalties not prescribed by Shari'ah on the grounds of an individual's judgement, In other words inventing their own Shari'ah. Banning cigarettes from a health code perspective is fine, to apply "ta'zeer" in the sense of physical penalties is inventing your own laws./ Which is contradicting the very claim of establishing Shari'ah

This is your teacher's assessment which is NOT Shari'ah., How does one decide if they're "Pretty sure"? You're either sure or you're not. This claims are highly subjective.

Brother, you have no idea. Ta'zeer is used when commanding what is good and forbidding what is evil with a punishment that can go from as little as a whip or even smaller or up to death (according to some scholars). It is up to the sultan.

here is a link on ta'zeer

and for those who don't know arabic here is a summary from a brother

                    To summarize the link:

It is the punishment not decreed legally, obligated by right to Allah or an individual, in any wrongdoing lacking a legally-defined punishment or compensation.

The difference between Qisas/Hudud and Ta’zeer is that Qisas deals with the rights of individuals while Hudud deal with the rights of Allah, and there is a legal, textual basis for their limits. There is no decreasing or increase those limits from the texts. While Ta'zeer does not necessarily deal with Allah's rights or an individuals and their is an element of Ijtihad and Ikhtiyar in it. Ta’zeer involves a level of ‘preference’ on the part of the judge or ruler in terms of determining the appropriate level of punishment depending on the circumstances, crime, and people involved.

In terms of the burden of proof, then Qisas and Hudud require clear proof or a confession with specific conditions, and a mere allegation against someone, hearsay, swearing of an oath, or the testimony of women does not suffice. Whereas Ta’zeer can be carried out based on the above or other means.

An important distinction between Hudud and Ta’zeer is that while the Hadd is averted by doubt, Ta’zeer can be established through it. Also, according to some scholars, Hudud can be subject to lapse, i.e. a statute of limitations, while Ta’zeer is not.

Also, Ta’zeer is intended to ward off crime and not harm people or destroy them, so amputation and hitting the head, privates, chest, or stomach are not allowed according to some scholars.

However, the punishment is at the discretion of the ruler and the definition and criteria for punishment changes from place to place and time to time. Ta’zeer can be inflicted on the body of a person, it can be a restriction of his freedom, or a fine.

While some scholars like Abu Hanifah, ash-Shafi’ee, and Abu Ya’la from the Hanabilah, said that a person cannot be killed as Ta’zeer, other said there are specific circumstances in which they can be, such as: the Muslim spy when he spies against the Muslims, and this was the view of Imam Malik, some of the companions of Ahmad. Also, the same who allowed killing the Muslim spy also allowed killing the caller to innovation that contravened the Qur’an and Sunnah, like the Jahmiyyah. Ibn Taymiyyah also mentioned that it is allowed to kill the criminal whose evil cannot be averted except by killing him and Abu Hanifah had a similar view with regards to crimes which are repeated.

In terms of lashes, then there are different views on the number allowable, however Umar RA was reported to have lashed a person several hundred times for taking from the Bayt al-Mal by altering the ledger. None of the Companions RA opposed this from him and so it is taken as Ijma’. Ali RA is also reported to have lashed someone 80 times for drinking alcohol during Ramadan, and this deals with the matter of difference wherein the Hanafis do not allow Ta’zeer to reach the level of Hadd, i.e. up to 39. The Hanabilah and Shafi’iyyah say no more than 20 lashes for Ta'zeer. Ibn Taymiyyah and Ibn Qayyim stated that the Ta’zeer should be determined by what general welfare dictates, and according to the extent of the crime, as long as it doesn’t exceed the Hadd, for example, stealing less than a Nisaab should not incur an amputation.

The rest discusses many details regarding Ta’zeer in terms of punishing with exile, harsh words, etc., and then goes into those crimes in which Ta’zeer is legislated. It is a fascinating article and really covers a lot of the issue of Ta’zeer.

                    Allahu A'lam.
at the time of abu bakr and umar (RA) the tazeer was applied a lot. For instance one time a sahabi in yemen applied his ijtihad on two women who were singing against the muslims. One was singing against the propthet (SAW) and the other against the muslims. the sahabi broke their two front teeth. He asked abu bakr (RA) through a letter about what he did and he said that as for the one who was singing against the muslims than the punishment that was given was too harsh and a lighter punishment should've been given and for the one who sang against the prophet (SAW) should've been executed.

I believe in what theyre doing but when a people are not used to certain laws they should not be forced on them over night but gradually over time, consider the wests influence on pashtuns, most pashtun grandmothers are women of the highest level of modesty and would never think of walking in public without the hijab but as secularism penetrated our society there are now women who walk around not wearing a scarf with no shame at all, the only reason this was successful is that it progressed at a slow pace, a pace suitable to the people and so each step in the wrong direction was a very small step and so people didnt really notice it, simillarly when we reapply islam in those lands liberated by muslim regimes they should not apply all the hudud over night but gradually over a number of YEARS so that the people find the rate of change comfortable and not alien to them, for our grandmothers or great-grandmothers would find the ways of women today abhorrent and rotten are they wrong or are we, truth is its all based on perceptions and if you believe in islam you will follow the islamic perception but its application in such a "corrupted" muslim society must be in a very delicate manner so as to attract people to the cause not push them away. This will serve islam in the long run but at a slower rate of return to the full hudood of allah.

A Whip eh? This is not done by Prophet Muhammad(saw). You're iinventing Shari'ah. Itjehad is not "ta'zir" and None of the ISIL are scholars nor have the authority to impose such rulings. you sir are clueless and brainwashed

In fact the ISIL should be punished for IMPOSING such punishments, as this is creating corruption in the land ...and the punishment in the Qur'an is to be have one arm/leg amputated.
