You know as I do that Muawiya was also a Tyrant. Let's be real on the matter. I know you know about the events that occurred after the Prophet. Unlike Shamlawer.

That's why I say he was more of an Opportunist. He couldn't be so blatant.

Lots of ignorant comments here by people that know absolutely nothing about Bangladesh but think they're experts by reading some Google websites and articles.

                  1. This is just politics and Hasina is actually helping out her former coalition partners, Jamaat out, as Asad71 pointed out.

                  2. Jamaat are not banned but under this decision cannot contest elections under their current trademark.

a - Their MPs do not lose their seats

b - They can contest the elections under a different name, format.

This has nothing to do with secularism v Islamism, as there are lots of other Islamic parties in Bangladesh, none of whom will be banned by the Awami League controlled courts (Awami League is the current ruling party, secular-leftist and aligned to India).

Here are two articles by Bangladeshis about this:

Zia Hassan: I don’t recognize this verdict as anything other than yet another move in the post-Shabag election game plan August 3, 2013

I am sorry to say that I don’t recognize this verdict as anything other than yet another move in the post-Shabag election game plan

by Zia Hassan, translated by Tibra Ali for AlalODulal.org

One of the lessons learned from Shahbag is that if you relax your ethical standards even the tiniest bit, it eventually backfires and that even the slightest unethical stance on a moral issue will ultimately tarnish your just cause.

Another parallel lesson is that the common people are able to detect if objectivity, fairness and equality of the justice system are applied subjectively, and this also sullies just cause.

The Skype scandal clearly showed us that there was clear collusion between the judge and the Chief Prosecutor, and the posting of the justices to the appeals court was dependent on the outcome of the decisions by them.

Even after the unmasking of such unethical behaviour, we all remained collectively silent. And when a few of us tried to speak out we were swiftly intimidated by being tagged as chagu or chupa. At the time, it was said that the Tribunal must not be criticized because if the Tribunal is criticized it will only strengthen the hands of the war-criminals. We accepted that argument for the interest of the greater good.

But now we see where that has lead us.

Ghulam Azam, the crown-prince of the razakars during the Liberation War – he was the main war-criminal and the razakar’s mastermind-in-chief, whose trial this nation has been eagerly awaiting for 40 years, a trial which has been the cause of activism by lakhs of people over the last 40 years, for which millions of words to be spoken, and editorials written, for which innumerable people have laid down their lives – the government has somehow found the system to save that very person from getting hanged.

This verdict (against Ghulam Azam) was the biggest betrayal of the blood of the martyrs since the Liberation War.

In the light of this incident I am inclined to view the verdict canceling Jamaat-e-Islami’s registration with great suspicion.

This is because, cancelling Jamaat’s registration by arguing that one of its clauses at registration is in conflict with the constitution gives rise to quite a few questions.

This verdict is a technical verdict and has nothing to do with banning Jamaat’s politics stemming from war crimes.

The essence of this verdict is that once you have enlisted using a particular party charter you can never ever change it. As a result, even when Jamaat wanted to change their charter, their changed charter was not accepted and their registration was cancelled based on the charter submitted during registration.

Since the registration process of the Election Commission has not yet been concluded this rejection of changing the charter looks like strong-arming.

And the second problem with all this is that it opens up yet another Pandora’s box which should have remained closed.

But it is as if if we never learn from our mistakes. One of the reasons for cancelling the registration is that Jamaat doesn’t recognize the people as the source of all power, instead they see the Creator as the source.

This is the kind of debate that has no end and which will divide the country in two, and to bring into the foreground a debate through a court verdict that is bound to encourage the rise of fundamentalism is very detrimental to this country. Bangladesh has alredy become a divided country thanks to the chain of events of the last few months and it is not desirable to divide it further by stabbing the people’s hearts once again.

The status quo in politics in this country is the status quo that encourages hooliganism and corruption, and to drag religion into it and make it into a big issue and create another round of ideological difference should have been avoided. And to use a sacred institution like the court system to do this deed should indeed be strongly condemned.

To achieve this there could be a referendum or it could be achieved through the Parliament. Since this was a political decision it should have been taken politically.

Another problem with all of this is, when Jamaat was writing that the people were not the source of all power, at the same time our national constitution recognized the Creator as the source of all power, and so the constitution itself was in conflict with its own principle of equality.

To my knowledge, never before has the registration of a political party been cancelled in Bangladesh.

Given the kind of political culture we have, the precedent of cancelling the registration of a party by finding a clause from its charter creates a dangerous, dangerous example. You can bet that in the future this example will be used by some dictator. And using this logic, it is possible to cancel the registration of every party by finding a clause in their charter that is in conflict with the constitution. For example, as far as I know, according to the current EC rules, none of the parties are supposed to have a student wing. But every party has a student wing. Many such contradictions, which can be shown to be in conflict with the constitution, can be found in the clauses of the charters of every party.

And so we have to return to the biggest problem which is the refusal to accept a changed charter even when the party wants to change their charter.

As a result, to single out Jamaat and cancel its registration is a selective judgement that has been enforced upon them.

It is clear that this is a political decision that has been obtained through the courts.

It is my opinion that political decisions should be taken politically.

If political decisions are pushed through the courts, it doesn’t just make the courts debatable, it destroys one of the pillars of the country. The court is the most sacred institution of a country. We are unable to fathom how dangerous it is to make the courts questionable and to exploit them for political ends. No country in the world allows this to happen, the citizens of the country don’t allow it.

There are political logic, emotions and public opinions behind every political decision. It doesn’t always have to be objective and fair. But the decisions of the courts have be to dispassionate, and based solely on ethics and equality. But in this case we can see that a selective judgement was obtained based on some very technical issues.

Besides, there is already a framework and a structure for taking such political decisions in Bangladesh. It’s called the Parliament.

And the Parliament has the power to take such decisions and in the 2008 elections the people of Bangladesh has given a mandate to Awami League to take such decisions. But the government did not take that route.

What was done is a cheap trick by the government.

This is just like the game that the government plays with Ershad, the way they pull the strings to manipulate the cases against him to keep his support, sometimes pulling him close and pushing him away on other occasions.

I am all for banning Jamaat’s politics based on their role as war criminals during the Liberation War.

This is a moral stance. Not only did Jamaat oppose the Liberation War, they took part in the massacres. They have never apologized for that role. In the rank of their leaders are all the people who were the leaders of razakar and al-badr death squads and they took part in the massacres. Ghulam Azam himself, after the war, toured the countries of the Middle East and campaigned for them not to recognize Bangladesh.

As a result this party really doesn’t deserve to or have the right do politics in this country from the moral point of view. Although this position is moral, the decision to ban their politics is a political one. But the government is imposing that decision according to its game plan by using a subservient court for its own political convenience.

And that is why I am sorry to say that I don’t recognize this verdict as anything more than yet another move in the post-Shabag election game plan.

After writing this post, it may seem that I am being too harsh on the Awami League. But, even if we ignore the history of the last twenty years, and consider only the history of the last six months after the Shahbag mass uprising, how the Awami League has made a chotpoti by mixing war criminals, Shahbag, the Tribunal, blasphemy, Islamic parties, Jamaat, Ghulam Azam, the spirit of liberation and whenever that chotpoti has lead to food-poisoning they have singled out whoever is necessary and has pulled them to its bosom or have dumped them – only in the light of calculations to make it across the next election challenge.

Right now, we have to judge the Awami League in the light of these recent actions. And using this standard of measurement there is no other option but to view this action of Awami League’s pet, the justice system, with suspicion.

Because, it is this Awami League who on one hand boycotts an iftar arranged by BNP because Jamaat will be there and the next day Sheikh Hasina’s son Joy attends another iftar at the American Ambassador’s residence with Jamaat, and the leaders of Awami League hold a meeting in that same person’s office before the verdict of Ghulam Azam. Therefore, not only will I be not surprised to see the government making a secret pact with Jamaat and form an electoral alliance with them by using the high court verdict to create pressure, and then use the supreme court to appeal and cancel that verdict, in fact, I think that is what will happen naturally.

Besides to cancel the registration and to ban Jamaat’s politics due to their war crimes are two very different things.

One is a technical issue and is a calculation related to election politics and the other is a moral position based on the country’s independent justice system, the rule of law and principles.

On the subject of principles, if we we don’t take a stance now against such technical chicanery of the electoral game, then we’ll soon be praising the government whenever it makes a move that we agree with or berate it and the justice system whenever they make a move that we don’t like. This is the wrong position to take. On such a morally powerful issue involving high ideals, fair justice and equality should be the basis of all decisions.

As a result I don’t want to take a stand either supporting or rejecting such a political hocus-pocus verdict. And I don’t want to be taken in by Awami League’s game moves.

Inspired by history I take the position of a skeptic. And my demand is this: Instead of using the courts to play a game using this or that technical issue, Jamaat-e-Islami be banned permanently by the Parliament on the basis of their war crimes.

                  ***

Everyone with brains in Bangladesh knows this has nothing to do with "secularism" but politics.

The Awami League - through the courts it controls through regime-appointed judges - is making life easier for Jamaat, whilst appearing to act against it.

Instead of banning them for their history of war crimes, they are banning them on a technical basis which can later be revoked.

The Bangladeshi nation and Bangladeshi middle class in particular hate Jamaat not because of "secularism" but because it is a party of war criminals and traitors.

Here are some other Islamic parties in Bangladesh, which no one would even consider banning and which are active now.

                    - Islamic Unity Front
                    - Islamic National Unity Front
                    - Islami Andolaon Bangladesh
                    - Khilafat Majlis
                    - Jamiat-i -Ulama -i Bangladesh

The case by which the court decided to invalidate Jamaat's registration was initiated by an Islamic organization, i.e. an Islamic organization took Jamaat to court.

It was a Sufi organization and Jamaat are hated by most of Bangladesh's Islamic community be they Deobandi, Sufi etc.

Anyway Jamaat recieved 4.6% of the votes in the last election and 4.4% in the election before and are a marginal party whom even many in their "ally", the BNP dislike.

As for Asad71, he is a Bangladeshi war hero (whom I have known for a few years) and has the background and experience to write a major book about the 1971 war.

He has been on battlefields and seen blood whilst some here have only seen blood on their Sony Playstation.

                        1. The Dhaka middle class that in some ways essentially rule Bangladesh are predominantly secular, the intelligentsia at least.

This is partly because of Dhaka university and the West Bengal influence. The middle class Muslims of West Bengal living in symbiosis with Hindus developed a more secular outlook compared to mainly Muslim East Bengal (now Bangladesh). Dhaka University is essentially an extension of Aligarh university in India.

So secularism and aspirations for "modernity" have always thrived in Dhaka due to the power of Dhaka university and the intellectuals it produced, and other factors.

                        2. So the intelligentisa and literati in Bangladesh are quite secular (though socially even they are conservative) in terms of political views.

Despite this Hizbut Tahrir did make some inroads in to the Bangladeshi middle class and educated elite and have a presence, though they are officially banned now.

It is thought that one attempt at organizing a coup (NOTE not an attempted coup, but a plan to try and get support for one) involved people sympathetic to HT (Hizbut Tahrir) last year.

As for Hizbut Tahrir themselves, they will not succeed as they are a party deviating from true Islam and even traditional orthodoxy and though many of their supporters in Indonesia, Uzbekistan, the west don't realize it have heavy Arab nationalism in their ideology.

Their glorification of Islamic history pre-1924 is false as Muslims fought Muslims, Muslims were conquered, defeated, massacred, enslaved even before 1924. The mighty "Khilafah" they revere could not stop the lands of Turkestan or the Caucasus falling to the Orthodox Russians.

They venerate the Ottoman Caliphate but most of their followers are ignorant of history and facts e.g. the Ottomans legalized homosexuality in 1858.

Groups like Hizbut Tahrir, thrive on ignorance and false romanticized pseudo-history.

My experience with both Ikhwanis and Hizbis is that they attract a particular type of Muslim to become one of them. A Muslim who enjoys a certain level of formal education lacking basic understanding of Islam and Islamic history.

Both Ikhwanis and Hizbis appeal to Western concepts of freedom, liberty, welfare state, socialism and similar ideas by dressing them up in an Islamic coat. Since a person with secular education doesn't know anything else, he will immediately bite the bait and join the party.

They teach their followers to pick and choose from the most liberal views in religious matters and still claim to be practicing and religious.

For example, you will see Ikhwanis and Hizbis wearing tigh pants, shaving, smoking cigarettes, shaking hands with women and even listening to music or using music to promote Shariah and Khilafah. They take women to the streets where anything can happen to them, and where they are vulnerable for attacks, to protest just like a bunch of Marxist radicals chanting and waving flags.

When you ask them simple questions about Islam, they philosophize and blabber on and on avoiding answering questions. Especially when they realize their core beliefs and dogma's are being challenged.
