ISLAMABAD: A constitutional petition, challenging the legal status of Prime Minister Syed Yusuf Raza Gilani after he was convicted in a contempt of court case was filed in the Supreme Court on Friday.
Advocate Azhar Siddique filed the petition under Article 184 (3) of the constitution, making the federation through Ministry of Law and Justice and Parliamentary Affairs and Prime Minister Gilani as respondents.
The petitioner contended that as Premier Gilani was convicted in a contempt of court case and was sentenced in the court for 30 seconds, hence he required to show under what authority of law he claims to hold the office of the Prime Minister of Pakistan. He prayed to the court to restrain Mr Gilani from holding the office of the premiership, and he should be stopped usurpation of his office and misuse of the facilities connected with the said office.
The petitioner submitted that it is travesty of the constitution of our country that in spite of a clear order of conviction having been passed against Prime Minister Gilani, he in utter disregard of that order is deliberately and defiantly continues to function as prime minister though law says that he cannot.
