Ease up on the Secularists, Secularists support DNA testing, while the Jamiets especially those under JUI oppse it as unislamic.

In regards to the stoning, its a shame, how nobody even mentioned the role Taliban have played in this, favoring their own supporters to escape punishment.

Real shame, real shame. Didnt expect that from you.
I am no expert on sharia and I don't know if DNA testing is allowed or not. Sharia can change with time and place. Its not a static law, the rules of 700 AD don't necessarily apply today. I don't support the Jamiet types nor do I condemn them. They are a political party and have done good and bad. Jamiat are not the spokespersons for muslims, just a political party. thats it.

Also I didn't specify who should be punished. I said the rapist should be punished be it Taliban or some police officer. Nobody is above the law. The article made some accusations against the Taliban and mangal bagh, I have no way to examine these claims. Trust me I won't condone the actions of Taliban. I am not their supporter. I judge their actions by merit, good or bad. I try to stay as neutral as possible but as with any human I have my weaknesses and biases which I try hard to control.

I will try to stay as impartial as possible.

Sharia is best suited for the desert peoples of Arabia, for whom it was custom made for. Sharia law has no place in a modern society.
The basis of sharia law is the Quran and the sunnah. As muslims we believe it to be divine. Now if you don't believe in a God and objective morality ofcourse you will say Muhammad (saw) created those laws. It all depends on what you believe. But as far as I am concerned subjective morality is not acceptable and anything can be justified and the powerful few can manipulate it serve their own goals. At least in Sharia nobody can alter the basic laws, which are firmly established.
The principles of Sharia are not all different from secular law in many instances, what parts of sharia don't you agree with. Sharia law is there to protect the poor from the cruel and distinguish between right and wrong. Without divine law, anyone can argue what they do is right. Who is to argue with a man who steals money from others for his own good? Without right and wrong and a reference point from where to judge right and wrong we are all in chaos.
You talk about public lashing as if innocent people are lashed, or when hands are cut its the innocent people. The law is there to punish criminals and wrong doers, do you agree that criminals must be punished? If not then what kind of justice you believe in. What is so different when somebody is electricuted in an electric chair in secular America to somebody's head being chopped off, is it just the method you object to?
Is life imprisonement worse or chopping somebody's head off. I think the secular punishment of life imprisonment is harsher. Capital punishment is easier way out.

Sadly, violent sexual crimes tend to be perpetuated by men in power situations and all the evidence, both actual and anecdotal suggests that religion, society, family etc. doesn't totally prevent it from happening. Even when we are shocked and sickened by it, we still do not know how to truly deal with it, and therefore carpets are lifted, the brushes come out and voices are silenced.

It is no wonder that Pashtoon men (but not only Pashtoon men) have a very protective attitude towards women. The problem is when we over-protect, we are then labelled as repressive. Sometimes, the old codes - badal, vendetta and tribal protection are the only things that appear to effective and 'fair' when redressing this type of crime.

May Allah bring peace to the victims and just punishments to the perpetrators. This is a sad piece of news to digest.

You are right. In Pakistan, you can't even open your mouth against army or isi.
Media spoke and speaking lot against taliban but its mouth is shut against army. Whatever army is doing in pukhtunkhwa or Balochistan, everyone is silence about those crimes, even the so called Pashtoon leaders are silenced.

The punishment for this animals would be castration and life long jail, I heard in jail new inmates are usualy raped by the others, so that do the justice for me or is that only the case in US jail?. Whith Sharia law like Amir mantioned would do nothing becuase were can you find witnesses nowhere. so just cut his junk off and let him rot in jail he would get his punishment there, Paki jail are hell on earth I have heard.
And of cours I am humanist and secularist so I would't mine if they use som anasthesia.

under amirs secular laws, this guy would be sent to prison and have a very good chance at seeing the light of day. if he did this in europe, in many countries he would be sent to a country club prison. under shariah the rapists head would be cut off. and he calls shariah backwards?
There are people today who think that admitting God’s absolute greatness decreases the value and importance of humans in the creation, as if God and mankind are rivals competing in greatness and power. Meanwhile I feel that whenever our perception of God’s greatness increases, with it we become greater, because we are the creation of a great God.

In many instances in the west, rapists are let free because of "good" behaviour only after serving a few years in jail. Apparently that makes someone more civilized. Even killers get reduced jail sentences becaues its too expensive to keep them in jail for such a long time. amazing stuff.

and they keep committing crimes and become career criminals because they always get released eventually.

most criminals in the US have been through the system already and keep doing what they are doing because prison is a revolving door for them.

There are so many NGOs and so called human rights commissions in Pakistan, that are striving for the same punishments for the criminals.
Thats why I say these NGOs are a big threat to our social system.

I always thought what could be the life of a Pashtana after a rape (whenever I read or hear about such cases)...Even the thought of it is so horrible!!!The family would be castigated for being unable to protect the girl. The brother would think of committing suicide and the father would never be able to keep up his head high. And the girl will never able to live a decent and honorable life again. The 'tor' will always be associated with her and even if she tries to forget, people will keep reminding her through thier attitude. Acceptance and integration of these victims into the society is a crucial issue, probably more important than deciding the modus operandi for punishing the criminals. The criminal may or may not get convicted but the victim is in perpetual conviction for the rest of her life. Perhaps the stigma associated with the rape could be erased if the society changes its negative attitude towards rape victims.

This abhorrent behavior towards victims appears to be related to mate gaurding tactics. The text below explains the creation of rape laws in the context of the facets of human evolutionary behavior (male dominance):

                            http://books.google.com/books?id=SbG...arding&f=false

"rape has been percieved as a crime against the victim's mate because, throughout evolutionary history, rape threatened the mate's reproductive success by potentially lowering his partenity certainty. Hence, selection favored males that responded to the rape of their wives in certain ways. One of those responses was to be suspicious that the copulation was actually rape. If the male perceived from his mate's actions that she had mated with other males under any number of circumstances, and that she was likely to continue to do so, his best evolutionary option was to abandon her, hence the interest of mates of rape victims in evidence of prior sexual promiscuity, physical injury indicating resistance, and collaborating testimony."

Far from being a moral prescription about male behavior, this evolutionary analysis of why males and the rape laws they have formulated are so uncharitable toward victims' claims of rape may be of help to those seeking change in the rape laws..."

I suspect that the sometimes nearly violent and hazing style behavior seen in multiple cultures, displayed towards girls from a family with no blood ties, by the mother in law and the females of the new husband's home, may have a similar basis and explanation (i.e. a view that resources that should have been kept within genetic kin's grasp is now threatened with distribution).

Khattaks are famous for being in largest number in pak army among pashtuns. It seems this khattak soldier has been influenced from his punjabi friends in army (punjab has rape and gang-rape culture) . Rape is unknown phenomena in southren KPK and FATA, this rape incident in karak is a shocking news...
                                some info about karak.
1- it is in southren kpk near kohat, it is home of khattaks.
2- it has highest literacy rate in pakistan.
3- since british times khattaks have heavy presence in army.
4- khattaks do not observe pardah in karak, you will find their women working in fields.
5- karak has largest gas reserves in pakistan.
6- its terrain is dry and sandy, and climate is hot.
