  • Muslim students in US may face jail for disrupting Israeli ambassador's speech

Muslim U.S. Students Convicted Of Disrupting Speech
SANTA ANA, Calif, Sept 23 (Reuters) - Ten Muslim college students from Southern California were convicted on Friday of unlawfully disrupting a speech by Israel's ambassador to the United States last year.

The verdict followed two full days of deliberations by a six-man, six-woman jury in a case that has touched off a furor over free speech rights at the University of California at Irvine.

The case stems from a protest organized by the Muslim Student Union at the university of a Feb. 8, 2010 speech there by Michael Oren, the Israeli ambassador to the United States.

Prosecutors say the students interrupted his appearance by yelling such insults as, "It's a shame this university has sponsored a mass murderer like yourself."

The U.S. Constitution guarantees Americans the right to freedom of speech.

But the Orange County District Attorney's Office, which is prosecuting the case, has said the students -- rather than exercising their own free-speech rights -- were interfering with the right of Oren to be heard.

The charges drew an outcry from civil liberties advocates and Southern California's Muslim community, who say the students were unfairly singled out for prosecution even though similar protests are common at universities and do not result in prosecution.

Spectators began wailing in the packed courtroom in Santa Ana, California when the verdicts were read by a court clerk, and about 50 people left the courtroom visibly upset.

The defendants, who are all in their early twenties, were convicted of one count each of conspiracy and disturbing an assembly and could face jail terms of up to a year, probation or community service at sentencing.

Charges have been tentatively dismissed against the 11th defendant.

"We're going to continue fighting this. We're going to appeal this decision," supporter Marya Bangee, 25, told Reuters outside the court.

"These men to us represent our struggle for civil rights in this country and for them to be found guilty and sentenced for speaking their minds is devastating for us all," Bangee said.

Erwin Chemerinsky, the dean of the law school at UC Irvine, has also criticized the criminal charges as heavy-handed.

The Muslim Student Union was suspended by the university for an academic quarter and put on probation for two years.

      Supporters of the "Irvine 11".

Reaction inside the Santa Ana courtroom for the so-called Irvine 11 verdict was one of shock and anger.
Some people began weeping, while 10 to 15 people stormed out in anger after all 10 students were found guilty of conspiring to disrupt and then disrupting a speech at UC Irvine last year by Israeli Ambassador Michael Oren.
Judge Peter J. Wilson had cautioned the 150 people who packed the courtroom, "Please remain in control of your emotions at all times."

Shakeel Syed, executive director of the Islamic Shura Council, said, "Two words: absolutely unbelievable."
He said the verdict will have far-reaching ramifications.
"I believe the heart of America has died today," Syed said.
He added that he was "absolutely shocked" at the verdict and called it a "direct blow" to Muslims in Orange County.
"This is clearly an indication that Muslims are permanent foreigners, at least in Orange County," he said.
The six male and six female jurors deliberated for more than two days and on Thursday had requested the court clerk to read back transcripts of the testimony.

        Punishing the 'Irvine 11,' again

In a case that never should have been filed, a jury delivered guilty verdicts against 10 of the 11 Muslim students who disrupted a UC Irvine speech by the Israeli ambassador to the United States.

        September 24, 2011

Last week, the public saw the best and worst of Tony Rackauckas. On Wednesday, the Orange County district attorney concluded a thorough yet timely investigation into the death of a homeless man, which resulted in the unusual decision to file charges against two Fullerton police officers. On Friday, in a case that never should have been filed, a jury delivered guilty verdicts against 10 of the 11 Muslim students who disrupted a UC Irvine speech by the Israeli ambassador to the United States. After one stupid incident, those students will forever have to answer yes if they are asked by, say, potential employers whether they were ever convicted of a crime.

The blame for this does not rest with the jury, whose job is to parse the evidence laid out before it. But criminal charges for unacceptably boorish behavior? Over the top. The whole sad affair has been taken too far when it could have been — and was — handled more appropriately by university officials.

The so-called Irvine 11 attended a speech at the university by Ambassador Michael Oren and, in an orchestrated attempt to disrupt his address, stood up one by one to yell out their objections. As each miscreant was escorted out of the room, another took up the verbal bombardment. Their defense — that they were exercising their own right to free speech — is out-and-out wrong. One's right to free speech, as the courts have long held, does not extend to attempts to erase the free-speech rights of others. There were many valid ways the students could have expressed themselves, such asholding signs, challenging Oren during question-and-answer time or protesting outside the building during his speech.

The university responded by suspending the Muslim Student Union, which it found to be behind the planned disruptions, and disciplining some of the students. Job accomplished.

The students were in the wrong, but there's such a thing as proportion. If college students faced criminal charges every time they misbehaved, we could fill the jails with undergraduates. At least the judge seemed to understand that, sentencing the students Friday to probation and community service rather than a fine or a jail term.

They will not face jail but have been convicted, with a permanent criminal record which will affect their chances of employment for the rest of their life.

They have been sentenced with probation.

That Jewish guy was telling all of those Muslims "You are failing your exam."

            Wow, nice.
O'faithful hearken thy vezir, for he promises them another Gandamak and for the ancestors of Hari Nalwa a similar fate has been sealed. We shall shake the foundations of their inner sanctums, written in gold and immortal will remain this endeavor of Afghans.

they could have simply not attended the speech if they didn't want to hear him. they could have gathered people in a different corner of the university and told them of why he was not worth listening to.
sure they were wrong when they interrupted his speech but one in year in jail is too severe of a punishment for a casual offense as such.
must we (muslims) represent ourselves as cultureless uncivilized freaks all the time??

I am no bird, and no nest ensnares me.
