  • Jizya in Quran is compensation and war reperation and not tax

After 9-11 there has been various debates about Islam. Some have said that the terrorist are Islam's true spoken. The so called moderates practice taqiya. Taqiya is the deliberate lying for the faith. They say Islam is a violent religion that commands Muslims to kill non Muslim. Non Muslims have 3 choices, either they convert, pay the jizya(tax) or die. They say Muhammad was peaceful for PR reasons and once strong showed his true colors and preached violent jihad. They say all the peaceful verses were abrogated after his final victory with this verse:

9.5. But when the forbidden months are past, then fight and slay the Pagans wherever ye find them, an seize them, beleaguer them, and lie in wait for them in every stratagem (of war); but if they repent, and establish regular prayers and practise regular charity, then open the way for them: for God is Oft-forgiving, Most Merciful.

    And also this verse:

9.29. Fight those who believe not in God nor the Last Day, nor hold that forbidden which hath been forbidden by God and His Messenger, nor acknowledge the religion of Truth, (even if they are) of the People of the Book, until they pay the Jizya with willing submission, and feel themselves subdued.

This verses are chosen for a reason. When read alone it implies a command to attack until they convert. Of course there are other verses in the Koran that talks about fighting. But why do they tend to focus on this one? Its simple, the other verses tend to show the defensive nature of the jihad and also the malicious intent and behavior of the pagans. Thus never cited. Lets look at some of them:

2.190. Fight in the cause of God those who fight you, but do not transgress limits; for God loveth not transgressors

2.191. And slay them wherever ye catch them, and turn them out from where they have Turned you out; for tumult and oppression are worse than slaughter; but fight them not at the Sacred Mosque, unless they (first) fight you there; but if they fight you, slay them. Such is the reward of those who suppress faith

2.193. And fight them on until there is no more Tumult or oppression, and there prevail justice and faith in God, but if they cease, Let there be no hostility except to those who practise oppression

    Also:

2.217. They ask thee concerning fighting in the Prohibited Month. Say: "Fighting therein is a grave (offence); but graver is it in the sight of God to prevent access to the path of God, to deny Him, to prevent access to the Sacred Mosque, and drive out its members." Tumult and oppression are worse than slaughter. Nor will they cease fighting you until they turn you back from your faith if they can. And if any of you Turn back from their faith and die in unbelief, their works will bear no fruit in this life and in the Hereafter; they will be companions of the Fire and will abide therein.

All these verses talks about fighting, however within these verses the defensive nature of the verses and the malicious behavior of the pagans is cited. Thus those who wish to attack Islam never cite those verses. Its a deliberate attempt to hide what the Koran as saying and using selective verses to imply what they know the verses does not mean.

Lets however look at the verse that is often cited. This time we will take the verses before and after it to see what is the context this verse is talking.

9.4. (But the treaties are) not dissolved with those Pagans with whom ye have entered into alliance and who have not subsequently failed you in aught, nor aided any one against you. So fulfil your engagements with them to the end of their term: for God loveth the righteous.

    6. If one amongst the Pagans ask thee for asylum, grant it to him, so that he may hear the word of Allah. and then escort him to where he can be secure. That is because they are men without knowledge. 7. How can there be a league, before Allah and His Messenger, with the Pagans, except those with whom ye made a treaty near the sacred Mosque? As long as these stand true to you, stand ye true to them: for Allah doth love the righteous.

Also in the same chapter it explains the reason behind all of these battles fought

9.13. Will ye not fight people who violated their oaths, plotted to expel the Messenger, and took the aggressive by being the first (to assault) you? Do ye fear them? Nay, it is God Whom ye should more justly fear, if ye believe!

The verses clearly indicate that no forced conversion was there. There are standards that the Koran established for fighting.

As for such who do not fight you on account of faith, or drive you forth from your homelands, God does not forbid you to show them kindness and to deal with them with equity, for God loves those who act equitably. God only forbids you to turn in friendship towards such as fight against you because of faith and drive you forth from your homelands or aid in driving you forth . As for those from among you who turn towards them for alliance, it is they who are wrongdoers. 60:8-9

Permission (to fight) is given to those against whom war is being wrongfully waged, and verily, God has indeed the power to aid them. Those who have been driven from their homelands in defiance of right for no other reason than their saying, ‘Our Lord is God.’ 22:39-40

These verses show us clearly that the battles the believers fought was purely for defensive purposes as the believers were being persecuted and then fought because they believed in the teachings of the Quran. The pagans wanted the Quran to cease to exist and wanted the prophet and his followers to persih. This is why freedom of religion in the Quran is sancrosanct. The Koran more than any other literature guarnteed the absolute right for freedom of belief and expression and thought.

The Koran makes clear the job of the prophet:

16:82 But if they turn away from you, your only duty is a clear delivery of the Message .

6:107 Yet if God had so willed, they would not have ascribed Divinity to aught besides Him; hence, We have not made you their keeper, nor are you a guardian over them.

4:79-80 Say:'Whatever good betides you is from God and whatever evil betides you is from your own self and that We have sent you to mankind only as a messenger and all sufficing is God as witness. Whoso obeys the Messenger, he indeed obeys God. And for those who turn away, We have not sent you as a keeper."

11:28 He (Noah) said "O my people! think over it! If I act upon a clear direction from my Lord who has bestowed on me from Himself the Merciful talent of seeing the right way, a way which you cannot see for yourself, does it follow that we can force you to take the right path when you definitely decline to take it?°

17:53-54 And tell my servants that they should speak in a most kindly manner. Verily, Satan is always ready to stir up discord between men; for verily; Satan is mans foe .... Hence, We have not sent you with power to determine their Faith.

88:21 22; And so, exhort them your task is only to exhort; you cannot compel them to believe.

But most of all the Koran asks the prophet himself this question:

10.99-100. If it had been thy Lord's will, they would all have believed,- all who are on earth! wilt thou then compel mankind, against their will, to believe! No soul can believe, except by the will of God, and He will place doubt (or obscurity) on those who will not understand

Then again the Quran tells us:

109.1-6 Say : O ye that reject Faith,! I worship not that which ye worship, Nor will ye worship that which I worship, And I will not worship that which ye have been wont to worship, Nor will ye worship that which I worship, To you be your Way, and to me mine

There is nothing even called conquest in the Koran and there is nothing called paying taxes and offensive war and spreading faith by the sword are not Koranic whatso ever and is a direct disobedience to the orders of the Koran. Jizya in the Quran came when the believers were entering Mecca where they were forced into exile and left their homeland losing their livlihoods, homes and businesses. Jizya was never mentioned except upon the pagans of Mecca. Jizya was a war reperation and compensation for damages. The prophet was in Medina where many non believers lived under his domain but was never ordered to seek Jizya. Later Muslim authorities apllied Jizya to anyone living under a Muslim ruler who are not Muslims as a form of tax. This is not the context it appears in the Quran.

So the concept that peaceful verses were abrogated by later verses that moved from defensive war to offensive has no backing from the Quran. This is because the permission allowed to fight has been outlined in the Quran. Only when provocked and forced should we fight. The prophet was a victim of religious coercion and persecution for religious propagation.

In the Quran we see the concept of religious persecution was a hallmark of pagan societies and oppressive tyrants.

They said: "O Shuayb! Much of what thou sayest we do not understand! In fact among us we see that thou hast no strength! Were it not for thy family, we should certainly have stoned thee! For thou hast among us no great position!" 11:91

(The father) replied: "Dost thou hate my gods, O Abraham? If thou forbear not, I will indeed stone thee : now get away from me for a good long while!" .19:46

The (people) said: "For us, We augur an evil omen from you: if ye desist not, we will certainly stone you , or a grievous punishment indeed will be inflicted on you by us." 36:18

They said: "If thou desist not, O Noah! thou shalt be stoned. 26.116

Pharaoh said, "Did you believe in him without my permission? This must be a conspiracy you schemed in the city, in order to take its people away. You will surely find out. "I will cut your hands and feet on alternate sides, then I will crucify you all." 7.123-124

All of these verses tell us how the prophets were persecuted for their religious propogation. The prophet of the Quran met the same fate. He was ordered to fight back and to complete the message of the Quran. But he was also ordered to limit his duty to preaching. If the people decide on him to judge between them than he is to do with justice.

So what is Jizya anyways and what does it mean:

The Arabic term jizya appears in verse Quran 9:29, but the Qur'an does not specify jizya as a tax per head. According to Paul Heck, the jizya taxation seems to be a developed form of the Sassanian practice of taxation.[10]

Commentators disagree on the definition and derivation of the word jizya:
Shakir and Khalifa's English translations of the Qur'an render jizya as "tax", while Pickthal translates it as "tribute". Yusuf Ali prefers to transliterate the term as jizyah.
Yusuf Ali states "The derived meaning, which became the technical meaning, was a poll tax levied from those who did not accept Islam, but were willing to live under the protection of Islam, and were thus tacitly willing to submit to the laws enforced by the Muslim State."[11]
Monqiz As-Saqqar attributes the word jizya to the root word jaza meaning "compensate" and defines it as "a sum of money given in return for protection".[12]
Ibn Al-Mutaraz derives the word from 'idjzã, meaning "substitute" or "sufficiency" because "it suffices as a substitute for the dhimmi's embracement of Islam."[12]
Yusuf al-Qaradawi says the word jizya is derived from the jazaa', meaning "reward", "return", or "compensation", and defines it as "a payment by the non-Muslim according to an agreement signed with the Muslim state".[13]
Edward William Lane, in An Arabic-English Lexicon defines jizya as a "tax that is taken from the free non-Muslim subjects of a Muslim government whereby they ratify the compact that assures them protection.[14]
Ibn Rushd explains that jizya is in fact a broader concept than just a head-tax. It also includes monies exacted in times of war – what is normally understood in English by the word ‘tribute’ – as well as levies (‘ushr) on non-muslim merchants who are trading in the Dar al-Harb.[15]

In practice, the word is applied to a special type of tax, levied upon the non-Muslim adult males living under an Islamic state.

After the Norman conquest of Sicily, taxes imposed on the Muslim minority were also called the "jizya".[5]

    http://en.wikipedia.org/wiki/Jizya

Lets look at how they define that term:

compensation, reward, substitute, tribute, return, sufficiency

Well we know from the Koran that there were many Jews and pagans living in Medina. We also know that they interacted with the prophet and that the prophet had political power over them to some degree. Yet there is no mentioning of Jizya except when the believers were just about to enter Mecca. Anotherwords Jizya in the Koran came when talking about the Meccans upon entering that city.

I don't know about you but i know if I was forced into exile and taken from my home and lost my possession and business and whatever else I had and suffered all those years from the pagans of Mecca because of my religious belief:

9.13. Will ye not fight people who violated their oaths, plotted to expel the Messenger, and took the aggressive by being the first (to assault) you? Do ye fear them? Nay, it is Allah Whom ye should more justly fear, if ye believe

I know I would want some compensation, some reward, some substitute, some tribute. Jizya is just like a war reperation and being compensated for damages. The believers entered Mecca where many of them came from, this is no conquest. Conquest(ghazu) has no mentioning in the Koran.

Jizya was imposed on the people who wrongfully fought and exiled and persecuted the believers.

60.8-9. Allah forbids you not, with regard to those who fight you not for (your) Faith nor drive you out of your homes, from dealing kindly and justly with them: for Allah loveth those who are just. Allah only forbids you, with regard to those who fight you for (your) Faith, and drive you out of your homes, and support (others) in driving you out, from turning to them (for friendship and protection). It is such as turn to them (in these circumstances), that do wrong.

The Koran gave the criteria of fighting for defensive purposes and for being forced out of your homeland without due cause. Jizya is then a compensation for the losses, a war reperation.

Prophets in the Quran are not allowed to receive any financial reward, but they can take money from the believers as charity. But this is voluntary as the Quran said.

“It is you who are asked to spend for the cause of Allah, but some of you behave in a niggardly way. Whoever behaves miserly does so against his own soul. Allah is Self-sufficient and you are poor (47:38).”

Quran respects people's right to believe and to give charity or not to believe and be stingy.

There was also the supposed Ridda wars that Caliph Abu Bakr fought. It was said that some people refused to pay Zakat. Paying Zakat is a decision people have to make for themselves. It is inconceivable that Abu Bakr will force people to pay Zakat if they do not want. Freedom is sacrosanct in the Quran. There are many EXPLICIT verses in the Koran regarding this.

The following is a fatwa concerning the same verses I talked about. This is from the Islamqa website. I bolded some parts for emphasis:

Some friends say that whoever does not enter Islam, that is his choice and he should not be forced to become Muslim, quoting as evidence the verses in which Allaah says (interpretation of the meaning):
“And had your Lord willed, those on earth would have believed, all of them together. So, will you (O Muhammad) then compel mankind, until they become believers”
    [Yoonus 10:99]
“There is no compulsion in religion”
    [al-Baqarah 2:256]
What is your opinion concerning that?.

    Praise be to Allaah.

The scholars explained that these two verses, and other similar verses, have to do with those from whom the jizyah may be taken, such as Jews, Christians and Magians (Zoroastrians). They are not to be forced, rather they are to be given the choice between becoming Muslim or paying the jizyah.

Other scholars said that this applied in the beginning, but was subsequently abrogated by Allaah’s command to fight and wage jihad. So whoever refuses to enter Islam should be fought when the Muslims are able to fight, until they either enter Islam or pay the jizyah if they are among the people who may pay jizyah. The kuffaar should be compelled to enter Islam if they are not people from whom the jizyah may be taken, because that will lead to their happiness and salvation in this world and in the Hereafter. Obliging a person to adhere to the truth in which is guidance and happiness is better for him than falsehood. Just as a person may be forced to do the duty that he owes to other people even if that is by means of imprisonment or beating, so forcing the kaafirs to believe in Allaah alone and enter into the religion of Islam is more important and more essential, because this will lead to their happiness in this world and in the Hereafter. This applies unless they are People of the Book, i.e., Jews and Christians, or Magians, because Islam says that these three groups may be given the choice: they may enter Islam or they may pay the jizyah and feel themselves subdued.

Some of the scholars are of the view that others may also be given the choice between Islam and jizyah, but the most correct view is that no others should be given this choice, rather these three groups are the only ones who may be given the choice, because the Prophet (peace and blessings of Allaah be upon him) fought the kuffaar in the Arabian Peninsula and he only accepted their becoming Muslim. And Allaah says (interpretation of the meaning):

“But if they repent [by rejecting Shirk (polytheism) and accept Islamic Monotheism] and perform As-Salaah (Iqaamat-as-Salaah), and give Zakaah, then leave their way free. Verily, Allaah is Oft-Forgiving, Most Merciful”

    [al-Tawbah 9:5]

He did not say, “if they pay the jizyah”. The Jews, Christians and Magians are to be asked to enter Islam; if they refuse then they should be asked to pay the jizyah. If they refuse to pay the jizyah then the Muslims must fight them if they are able to do so. Allaah says (interpretation of the meaning):

“Fight against those who (1) believe not in Allaah, (2) nor in the Last Day, (3) nor forbid that which has been forbidden by Allaah and His Messenger (Muhammad), (4) and those who acknowledge not the religion of truth (i.e. Islam) among the people of the Scripture (Jews and Christians), until they pay the Jizyah with willing submission, and feel themselves subdued”

    [al-Tawbah 9:29]

And it was proven that the Prophet (peace and blessings of Allaah be upon him) accepted the jizyah from the Magians, but it was not proven that the Prophet (peace and blessings of Allaah be upon him) or his companions (may Allaah be pleased with them) accepted the jizyah from anyone except the three groups mentioned above.

The basic principle concerning that is the words of Allaah (interpretation of the meaning):

“And fight them until there is no more Fitnah (disbelief and polytheism, i.e. worshipping others besides Allaah), and the religion (worship) will all be for Allaah Alone [in the whole of the world]”

    [al-Anfaal 8:39]

“Then when the Sacred Months (the 1st, 7th, 11th, and 12th months of the Islamic calendar) have passed, then kill the Mushrikoon (see V.2:105) wherever you find them, and capture them and besiege them, and lie in wait for them in each and every ambush. But if they repent [by rejecting Shirk (polytheism) and accept Islamic Monotheism] and perform As-Salaah (Iqaamat-as-Salaah), and give Zakaah, then leave their way free. Verily, Allaah is Oft-Forgiving, Most Merciful”

    [al-Tawbah 9:5]

This verse is known as Ayat al-Sayf (the verse of the sword).

These and similar verses abrogate the verses which say that there is no compulsion to become Muslim.

And Allaah is the Source of strength.

Majmoo’ Fataawa wa Maqaalaat li’l-Shaykh Ibn Baaz, 6/219

    http://islamqa.info/en/ref/34770

Now we can see we have two very different interpretations of the Quran. However unlike our friend here I looked at the verses based on its QURANIC CONTEXT and did not cheat by invoking ABROGATION. If these verses were abrogated as this cleric seem to say then what are those verses still doing in the Quran?

Most Muslims of course are not aware of all this. They think that many aspects of what they are told are explicitly mentioned and supported by the Quran. They do not know anything about abrogation. But this is why many Islam bashers attack Islam and attack the prophet claiming he cancelled all the peaceful verses after he achieved victory. In fact all the Quran are peaceful verses and all the Quranic verse are equal in authority and the prophet was a man of principle and did not alter the Quran according to his liking.

    Quran is peace.

aren't the quran only muslims like 1400 years late? if every hadith is wrong, then the whole history of muslims has been wrong, what is the point of religion then?

Its not that hadith are wrong, its that some hadiths violates the Koran but the sects in Islam became sectarian and refused to question them even if it means they have to abrogate the Koran.

In the end many Sunnis say the same about the Shias and vice versa. But each of these sects refuse to question their own authority. This is known as sectarianism. The Quran should be the final judge. Any hadith that agrees with the Koran should be taken and if not then it shoud be discarded. Abrogation is a crime against the Koran.

Finally God is not going to ask the Sunni or Shia laymen about shariah and fiqh. Its not their domain. All Islamic sects are monotheist and all believe in God and judgement day. So it does not affect salvation. But when shariah law is applied than it will have an affect since many laws that Sunnis and Shia believe are life and death matters and have a big effect on people.

but Qur'an is very context dependent, wouldn't it mean that ahadith are also similarly context dependent? so how can they be contradictions when they depend on context?

if muslims invaded and took over countries and forced the people in those countries to pay a higher tax than themselves and the converts to islam, for poor people, that would be pressure to conform to the wishes of the oppressors.
so what is the point here?

Jizya is paid for protection. Protection from whom? From the Muslim himself obviously. It's a form a tribute that the conqueror levies upon the conquered, call it Vae Victis. Many other conquerors such as Genghis Khan levied tribute upon subdued peoples. War doesn't pay for itself after all. Genghis was also remarkably tolerant of other religions himself and never threatened any faith. Nestorian Christianity flourished under the Mongols. Does that Justify the Mongol's brutality? The fact is, Muslim armies went to foreign lands, conquered them, subdued populations, and then charged them to continue practicing their indigenous faith. That doesn't sound like a favour to me.

While Jizya was a reasonably good idea for the 7th century it cannot be justified by modern morality. It is time to look to the future rather than be tethered to the 7th century. Islamic values might be applicable for all time but certain archaic customs and rituals are temporal in nature and should be left buried in the past.

Islamic values might be applicable for all time but certain archaic customs and rituals are temporal in nature and should be left buried in the past.
actually there's many ahadith which says eventually jizya will be abolished.
