  • IMPORTANT: Books and articles concerning what Nullifies your Islam!

As salaamu aleikoum wa rahmatullahi wa barakatuhu,

In recent discussions, it has become apparent that some members who argue in favor of promotion of vice are ignorant of the fact that their tolerance for vice raises the risk of the nullification of one's testimony of faith.

The ignorance of us regarding such critical matters in our religion is a grave concern that is being neglected.

I urge all members to take some time off and read a few short books and articles explaining some very important matters regarding nullification of ones testimony of faith and leaving the folds of Islam.

    What Negates One's Islam
by Shaikh-ul-Islam Muhammad bin Suleiman At-Tamimi
    http://www.uh.edu/

Shaikh-ul-Islam Muhammad bin Suleiman At-Tamimi stated, "Know that ten matters negate one's Islam. [They are:]
"First, associating partners in the worship of Allah. Allah says,
"Verily, Allah forgives not (the sin of) setting up partners in worship with Him, but He forgives whom He pleases other sins than that" (al-Nisa 116).
    Allah also says,
"Verily, whosoever sets up partners in worship with Allah, then Allah has forbidden Paradise for him, and the Fire will be his abode. And for the wrongdoers, there are no helpers" (al-Maidah 72).
Included in this category of deeds is sacrificing animals for the sake of jinn or graves.
"Second, whoever sets up an intermediary between himself and Allah, whom he prays to, seeks intercession from and puts his reliance in, has blasphemed according to the consensus of the scholars.
"Third, whoever does not consider the polytheists as disbelievers or whoever has doubt concerning their disbelief or whoever considers their way as correct has committed an act of disbelief himself.
"Fourth, if a person believes that some guidance other than the guidance of the Prophet (peace be upon him) is more complete than his or that another's judgment is better than the Prophet's, [then that person has committed an act of disbelief]. This would be like the one who prefers the rule and law of false gods [be they human or otherwise] over the Prophet's rule and law. This position is one of disbelief.
"Fifth, whoever dislikes anything the Prophet (peace be upon him) brought, even if he acts by it, has committed an act of disbelief.
"Sixth, whoever ridicules or jokes about any part of the religion of the Messenger (peace be upon him) or its rewards or its punishments, has committed an act of disbelief. The evidence for this is in the Words of Allah,
"Say: Was it Allah, or His signs or His Messenger that you were mocking? Make no excuse, you have disbelieved after you had believed." (al-Tauba 65-66).
"Seventh, the performing of magic [is an act of disbelief], this includes those magical incantations that make one love or hate another person. Whoever performs them or is pleased with them has committed an act of disbelief. Allah says in the Quran,
"But neither of these two (angels) taught anyone (such things) until they had said, 'We are only for trial, so disbelieve not [by learning such magic from us]"' (al-Baqara 102)
"Eighth, assisting and supporting the polytheists against the Muslims [is also a type of disbelief]. The proof for this is in Allah's statement,
"And if any among you takes them [the Jews and Christians] as helpers and protectors, then surely he is one of them. Verily, Allah guides not those people who are wrongdoing" (al-Maida 51).
"Ninth, if a person believes that some people are permitted to be free of the Law of Muhammad (peace be upon him), in the same way that Khidr was free of the law of Moses (peace be upon him), then that person is a disbeliever.
"Tenth, turning away from the religion of Allah, not learning it or applying it, [is also a form of disbelief]. The evidence for this is Allah's saying,
"And who does more wrong than he who is reminded of the signs of his Lord, then he turns aside therefrom? Verily, We shall exact retribution from the sinners" (al-Sajdah 22).
"There is no difference with respect to all of the above whether the act is done jokingly, seriously or out of fear. The only exception is one who is coerced. All of them are from the greater of the dangerous acts and they are also among the most common in occurrence. A Muslim must be aware of them and fear for himself concerning such actions. We seek refuge in Allah from that which brings about His anger and the painfulness of His punishment"

Hypocrisy is of Two Types: With Respect to Belief and with Respect to Actions
Hypocrisy with respect to beliefs is of six types. The one who is guilty of any of them will be in the lowest pit of the Hellfire. These are:

    (1) Denying or disbelieving the Messenger (peace be upon him).
    (2) Denying something that the Messenger (peace be upon him) presented or taught.
    (3) Having hatred for the Messenger (peace be upon him).
    (4) Having hatred for something the Messenger (peace be upon him) presented.
    (5) Being pleased if the religion of the Messenger (peace be upon him) is diminished or weakened.
    (6) Being displeased if the religion of the Messenger (peace be upon him) is strengthened or victorious.

Ten things which nullify one's Islaam

All praise is due to Allaah, Lord of the worlds. May peace and salutations be upon the Last Messenger of Allaah, and upon all those who follow him until the Last day. To proceed: Brother and Sister Muslim, you must be aware that there are matters which nullify your Islaam. Please be mindful of them:

1 - Associating partners with Allaah (shirk). Allaah Most High says (in the meaning ):

{Truly, whosoever sets up partners with Allaah, then Allaah has forbidden the Garden for him, and the Fire will be his abode. And for the wrongdoers there are no helpers}, [Soorah al-Maa.idah, Aayah 72].

Calling upon the dead, asking their help, or offering them gifts or sacrifices are all forms of shirk.

2 - Setting up intermediaries between oneself and Allaah, making supplication to them, asking their intercession with Allaah, and placing ones trust in them is unbelief (kufr).

3 - Anyone who does not consider the polytheists (mushrikeen) to be unbelievers, or who has doubts concerning their unbelief, or considers their way to be correct, is himself/herself an unbeliever (kaafir).

4 - Anyone who believes any guidance to be more perfect, or a decision other than the Prophets decision to be better, is an unbeliever. This applies to those who prefer the rule of Evil (Taghoot) to the Prophets rule. Some examples of this are:

                      (a) To believe that systems and laws made by human beings are better than the Sharee'ah of Islaam; for example, That the Islaamic system is not suitable for the twentieth century. That Islaam is the cause of the backwardness of the Muslims. Or that al-Islaam is a relationship between Allaah and the Muslim. It should not interfere in other aspects of life.

(b)To say that enforcing the punishments prescibed Allaah, such as cutting of the hand of the thief or the stoning of an adulterer, is not suitable for this day and age.

                      (c) To believe that it is permissible to give a rule from that which Allaah did not reveal in Islamic transactions or matters of law, punishments or other affairs. Although one may not believe such things to be superior to the Sharee'ah he in effect affirms such a stand by declaring a thing which Allaah has totally prohibited, such as adultery, drinking alcohol or usury, to be permissible. According to the consensus of the Muslims, one who declares such things to be permissible is an unbeliever (Kaafir)

5 - Anyone who hates any part of what the Messenger of Allaah [sal-Allaahu `alayhe wa sallam] has declared to be lawful has nullified his Islaam, even though he may act in accordance with it. Allaah Most High says (in the meaning):

{This is because they hate what Allaah has sent down, so he has made their deeds fruitless}, [Soorah Muhammad, Aayah 9].

6 - Anyone who ridicules any aspect of the religion of the Messenger of Allaah [sal-Allaahu `alayhe wa sallam], or any of its rewards or punishments, becomes an unbeliever. Allaah Most High says (in the meaning):

{Say: Was it Allaah, and His signs and His Messenger that you were mocking? Make no excuse; you have disbelieved after you had believed}, [Soorah at-Towbah, Aayahs 65-66].

7 - The practice of magic. Included in this, for example, is causing a rift between a husband and wife by turning his love for her into hatred, or tempting a person to do things he dislikes using black arts. One who engages in such a thing or is pleased with it is outside the fold of Islaam. Allaah Most High says (in the meaning):

{But neither of these two (angels, Haaroot and Maaroot) taught anyone (magic) till they had said, Indeed, we are a trial; then do not disbelieve}, [Soorah al-Baqarah, Aayah 102].

8 - Supporting and aiding polytheists against the Muslims. Allaah Most High says (in the meaning):

{Whoever among you who takes them as allies is surely one of them. Truly, Allaah does not guide the wrongdoers}, [Soorah al-Maa.idah, Aayah 51]

9 - Anyone who beleives that some people are permitted to deviate from the Sharee'ah of Muhammad [sal-Allaahu `alayhe wa sallam] is an unbeliever by the word of Allaah Most High (in the meaning):

{And whoever seeks a religion other than Islaam, it will not be accepted of him, and in the hereafter he will be from among the losers}, [Soorah Aal-'Imraan, Aayah 85]

10 - To turn completely away from the religion of Allaah neither learning its precepts nor acting upon it. Allaah most high says (what means):

{And who does greater wrong than he who is reminded of the revelations of his Lord and turns aside therefrom Truly, We shall exact retribution from the guilty}, [Soorah as-Sajdah, Aayah 22].

And He (Subhaanahu wa Ta'aala) also says (what means):

{But those who disbelieve turn away from that about which they are warned}.

It makes no difference whether such violations are committed as a joke, in seriousness or out of fear, except when done under compulsion (i.e. from threat of loss of life).

We seek refuge in Allaah from such deeds as entail His wrath and severe punishment.

The Vices of Polytheism- The Virtues of Monotheism

Imaam Shah Ismail Shaheed - From the book Taqwiyat-ul-Iman
                        The polytheism cannot be forgiven:
{Verily! Allah forgives not (the sin of) setting up partners in worship with Him, but He forgives whom He pleases, sins other than that, and whoever sets up partners in worship with Allah, has indeed strayed far away.}(V.4:l16)
The one who does not discriminate between the permissible and the forbidden, commits theft, idles away his time doing nothing, shuns his prayers and fasting, does not give his wife and children their due rights and becomes incumbent on disobeying his parents -has indeed strayed from the path of Allah, but the one who gets strangled in the quagmire of Shirk has strayed very much far away by getting involved in such a sinful act as shall never be forgiven by Allah except by showing repentance. As far as other sins are concerned, Allah may perhaps forgive them even without repentance (on the part of the slave). It becomes thus known that Shirk is an unpardonable crime and the person who commits it is bound to be punished. If an act of Shirk, thus committed, is of such an extreme kind which turns a person into a polytheist, then the penalty thus incurred by the person is an eternal Hell-fire, for he will neither be ever released from it, nor shall get any rest and peace whatsoever therein. As to the acts of minor degree of Shirk [1] , their doers are bound to be penalized according to the penalties which are apportioned for them by Allah the Exalted.
As far as the penalties which have been specified by Allah in regard to other sinful acts are concerned, they mainly depend on the Will of Allah. (Depending on His Will, He may forgive them or, He may punish the doer).
                        Explaining Shirk:
We thus understand that Shirk is the biggest of all sins (i.e. and no sin surpasses it in terms of gravity, severity and enormity). It can be explained by the following example:
Let us suppose that a king has a specific penal code for his subjects comprising all kinds of penalties for different kinds of offences like, theft, robbery, sleeping while being on duty as a guard, a delayed arrival at the king's court, fleeing from the battlefield and delaying the payment of government revenues etc. are all crimes deserving specific punishments. The king, depending on his will, can either duly punish the offenders or forgive them, but there are a few crimes whose commission clearly indicates a rebellion, like an act of coronating and enthroning a nobleman, a minister, a fief, a chieftain, a sweeper or a shoe-maker and declaring anyone of the above as a king in the presence of the king himself. Such an act shall be considered as a mutiny. Or similarly, if a throne or a crown is made for any of the above categories of people or anyone of them is called with such title as 'Your Excellency' or 'His Highness' or 'His Majesty' or is treated with the observance of a royal protocol or a certain day is specified for him as a gala festival or a certain vow is made to him after a royal fashion, is what constitutes the greatest of all crimes which must never go unpunished. A monarch who overlooks giving out punishments on such crimes, is bound to have a weak and staggering empire and the wise people shall libel such a monarch as incapable and unworthy of ruling an empire. Dear friends! Let us fear from the Master of the universe, the Sovereign who has a great sense of honor and an unlimited power. How can such a Lord let the polytheists go unpunished! May Allah bless all the Muslims with His mercy and save them from such dangerous calamities as Shirk. Amin!
Shirk, the greatest of all vices:Allah the Exalted One says in one of His verses:
{And (remember) when Luqman said to his son when he was advising him: 'Join not in worship others with Allah. Verily! Joining others in worship with Allah is a great Zulm (wrong) indeed.}(V.3l:13)
It means that Allah had awarded clairvoyance to Luqman {May Allah have mercy on him} By utilizing his mental faculties, he understood that giving away someone's right to someone else is an act of great injustice. The one who gives away Allah's Right to someone else among His creatures is similar to a person who gives away something to the meanest one, what in fact is due to be given to the greatest one. As long as Allah is the Greatest of all and all His creatures rank no more than a slave before Him, what injustice should be greater than putting a royal crown on the head of a shoe-maker! We must understand that anyone whether one of the most eminent human beings or any of the angels dearest and nearest to Allah does not carry the status of even a shoe-maker in terms of frivolity and disgrace, while facing the magnificence of Divinity. Thus it becomes clear that as Shari'ah has regarded Shirk to be an extremely enormous sinful act, one's wisdom and common intellect also recognizes Shirk to be as such. It is the greatest of all vices which is a fact, because the greatest of all inequities to be found in a man is that he should disrespect his elders. Who else is bigger than Allah in greatness! Committing an act of Shirk verily amounts to being disrespectful towards Him.
Tauhid (Monotheism) is the only way out:Allah has said in one of the verses of the Noble Qur'an:
{And we did not send any Messenger before you (O Muhammad {peace be upon Him}) but We inspired him (saying): La ilaha ilIa Ana [none has the right to be worshipped but I (Allah)], so worship Me (Alone and none else).} (V.2l:25)
It means that all the Messengers were sent by Allah with exactly the same commandment that none but Allah should be worshipped and only Allah is worthy of being worshipped. We thus understand that the commandment in regard to the recognition of Oneness of Allah and the prohibition concerning the joining of others in worship with Him is a matter which is a common constituent of all the previous revealed doctrines, and hence this is the only way out for one's salvation. The rest of all the other creeds are in error.
                        Allah is disgusted with Shirk:
It is reported by Abu Hurairah {May Allah have mercy on him} that Allah's Messenger {Peace be upon Him} said: Allah has made the following statement:
"I am most dispensed with the action of joining others in worship with Me. Whosoever does an act in which he joins others in worship with Me, I shun him and his partners and become disgusted with him."
It means that unlike others who divide their shared goods among themselves, I do not do so because I stand in need of no one. Whoever performs a virtuous deed for Me by giving Me a partner in it, I do not even take My share and leave the whole of it for others and become disgusted with him. It thus becomes known to us that whoever does an act for Allah, and does the same act for an entity other than Allah, he has indeed committed Shirk and it further elaborates that any act of worship which is dedicated to Allah by the polytheists is unacceptable. Allah is disgusted with such acts and such people.
Affirming the Oneness of Allah prior to the dawn of time itself:Allah the Exalted says:
{And (remember) when your Lord brought forth from the children of Adam, from their loins, their seed (or from Adam's loin his offspring) and made them testify as to themselves (saying): 'Am I not your Lord?' They said: 'Yes! We testify,' lest you should say on the Day of Resurrection: 'Verily, we have been unaware of this. Or lest you should say: 'It was only our fathers aforetime who took others as partners in worship along with Allah, and we were (merely their) descendants after them; will You then destroy us because of the deeds of men who practiced Al-Batil (i.e. polytheism and committing crimes and sins, invoking and worshipping others besides Allah)?}(V.7:172,173)
It has been reported by Ahmad on the authority of Ubai bin {May Allah have mercy on him} in regard to the interpretation of the verse (regarding the time when Allah made the offspring of Adam testify) saying that Allah gathered all the progeny of Adam, formed them in pairs, then made their facial features and shapes, then gave them the power of speech. When they began to speak, He took a covenant from them by asking them, "Am I not your Rabb?" They answered, "Verily, You are our Rabb!” [2] Allah then stated, "I hereby make all the seven strata of heavens and earth as well as your father Adam a witness unto you lest you should employ an excuse of being unaware of it on the Day of Resurrection. Be certain that none is worthy of being worshipped except Me and none but Me is your Rabb. Do not associate partners with Me in worshipping. I shall keep sending my Messengers unto you who will in turn continue to remind you of this covenant of yours with Me and I shall reveal my Books unto you." All of them answered, "We hereby testify that You are our Rabb and You are the object of our worship. None but You is our Lord and none but You is worthy of our worship. Shirk cannot be presented as an authority:
Ubai bin Ka'b{May Allah have mercy on him}, while interpreting the above verse said that Allah gathered all the offspring of Adam at one place, formed them into groups, for instance, He separated the Prophets, saints, martyrs, pious people, obedient ones, disobedient ones into different groups. Similarly, He segregated the Jews, the Christians, the polytheists and the followers of every religion. Then whatever facial features and shapes one had to be given in this world, Allah made them appear exactly in the same manner there accordingly. Someone was made to appear as good-looking, someone as bad-looking, someone as conversant, someone as dumb, and someone as a lame person. Then all of them were given the faculty of speech and then asked, "Am I not your Rabb?" All of them acknowledged the lordship of Allah and then Allah took a pledge from all of them to the effect that they shall not take anyone as their ruler and master except Him Alone and shall not consider anyone worthy of being worshipped except Him Alone. Then Allah made all the seven strata of heavens and earth as witnesses and said that the Prophets shall be sent unto you to remind you of this pledge of yours and they shall bring with them the heavenly scriptures. Everyone has individually affirmed the Oneness of Allah and rejected associating partners with Him in an era prior to the dawn of time itself and therefore, no one may be presented as an evidence in the matter of Shirk (i.e. a preceptor, a mendicant, a sheikh, a father, a grandfather, a king, a religious scholar or a saint).
The excuse of forgetfulness shall not be accepted:
If someone thinks that after being in this world, we no longer remember the said pledge and in case we commit an act of Shirk now, we shall not be punished as there is no questioning in forgetfulness. The answer to this notion of theirs is that there are many things a man does not remember but once reminded by a creditable and authentic person, it all comes back to his memory. For instance, no one remembers his date of birth, but once he hears about it from people, he has no qualms about saying it with certainty that I was born on such and such date, in such and such year and at such and such hour. He only recognizes his parents upon hearing from people. He does not consider anyone else as his mother. In case one does not perform his obligations towards his mother and proclaims someone else as his mother, the people are bound to ridicule and censure him. In response to their chidings, if he postulates that as long as I do not remember my birth, why should I consider this woman as my mother? People have no reason to castigate me about it! Once this person blurts out such a statement, people shall definitely regard him to be a perfect moron and a rude person. It thus becomes known to us that since a man believes in many a thing to the extent of certitude on the basis of hearing them merely from people, how is it that he should disbelieve the teachings of the Prophets who are the people of a great status and magnificent caliber!
The basic teachings of the Prophets and the (Divine) Scriptures:
Thus we understand that every one has been individually inculcated and stressed upon in the realms of the spirits to adopt and adhere to the concept of Tauhid [3] (Monotheism) and shun Shirk (polytheism), i.e. associating partners with Allah in the acts belonging to Him. All the Prophets have been sent to this world for the sole purpose of reminding people of this covenant and its renewal. The instructions of more than one hundred and twenty-four thousand Messengers of Allah and the central knowledge contained in all the Divine Scriptures concentrate on just one point, "Beware! the concept of Tauhid (Monotheism) should not be tampered with and do not even think of associating partners with Allah! Do not consider anyone as an absolute sovereign and a disposer (of the affairs) except Allah! Do not resort to anyone for the fulfillment of your wishes and making vows except Allah!"
Once we are informed about the following Hadith, there is no room left whatsoever for an excuse to commit an act of Shirk by anybody. This is how the Hadith goes:It is narrated by Mu'adh bin Jabal {May Allah have mercy on him} that he was instructed by the Prophet {Peace be upon Him} to the effect that:
"You must not join others as partners with Allah even if you are murdered or burnt to death." (Musnad Ahmad)
This means that we must not consider anyone else other than Allah as worthy of being worshipped and do not care for being molested by a jinn or devil. As the Muslims must patiently bear the brunt of the external calamities, without jeopardizing their Faith, they must also bear the internal inflictions (i.e., molestations on the part of jinns, ghosts and other such beings) with patience without perverting their Faith out of their fright. They should hold the belief that everything whether an affliction or comfort is directly governed by Allah. Allah sometimes puts
his faithful believers on trial. A believer is tested according to the strength of his Faith. Sometime pious people are subjected to chastisement on the part of the wicked persons so that a distinction may be established between the sincere and the hypocrite. As the pious are apparently molested by the disobedient ones and the Muslims by the disbelievers (through the Will of Allah) and they continue to bear with it with perseverance and patience without perverting their Faith due to being disgruntled with the trials, similarly the pious are sometimes subjected to trouble on the part of jinns and Satans through the Will of Allah. So one should bear with it steadfastly and patiently without yielding to their hegemony out of the fear of their oppression. Thus it becomes known to us that if a person denies a deity (false deity other than Allah) out of being averse to Shirk, repudiates and condemns making vows and offerings to it, removes the erroneous and unjustified customs associated with it; and in the process of doing it, if such a person incurs either a loss of life or a loss in terms of finances, or should Satan happen to chastise him in the name of a preceptor or a martyr (by making such fake appearances), he must understand that Allah is testing his Faith which he must humbly bear with and should hold on to his Faith steadfastly. We must remember that Allah tightens His grip on the oppressors after giving them plenty of rope and liberates the oppressed from their talons, similarly He shall grab on to the oppressors among the jinn in due course of time and shall release the adherents to the concept of Oneness of Allah (the monotheists upholding the cause of 'Tauhid') from their tyranny.
It has been narrated by Ibn Mas'ud {May Allah have mercy on him}:
"A person enquired of the Prophet {Peace be upon Him} as to which is the biggest of all sins. He said that it is to call upon someone else other than Allah, thinking of him as similar to Allah, even though Allah has created you." (Al-Bukhari-Muslim)
It means that as Allah (on account of His Knowledge and Capability), is believed to be the Omnipresent and the Conductor of the whole universe, and is called upon in times of distress, similarly calling upon some other entity other than Allah believing in it to be characterized by the same qualities is the greatest of all sinful acts. Because none has the capability to solve the problems of creatures except Allah. Furthermore, as long as our Rabb is Allah, we must call upon Him Alone in distress situations as we have no link with any other entity. For example, if someone becomes a slave to a king, he is bound to approach his king for the fulfillment of all his needs. Not to speak of a shoe-maker or a sweeper, he will not even approach other kings (for his personal needs). Since there is no entity at all, whatsoever, who could be considered a counterpart of Allah, is it not a folly to approach any other entity for the fulfillment of one's needs?
                        Tauhid (Monotheism) and forgiveness:
It has been narrated by Anas {May Allah have mercy on him} that the Prophet {Peace be upon Him} said:

"Allah the Exalted states to the posterity of Adam that if you happen to meet Me with the sinful acts of the entire world, I shall meet you with an equal amount of mercy provided you have not joined partners with Me."
It means that there had been many delinquent and sinful people in the world including Pharaoh and Haman etc. as well as Satan, who also is to be found in this world. All these sinners have been committing sins and shall continue committing them till Doomsday. Now, if a person supposedly commits all these sins collectively to his sole account individually, chances are that Allah shall bestow on him an equal amount of mercy and forgiveness, provided he has not committed Shirk. Thus it becomes known to us that with the blessing of Tauhid, all the sins are forgiven [4] exactly in the same manner as the virtuous deeds are destroyed by the evil of Shirk. This is also a fact that when a man is completely cleansed off the impurities of Shirk and shall uphold a faith that none but Allah is his Master, and there is no place to flee His Rule, none offers shelter to the ones who disobey Him, all are helpless before Him, none can deter His Commandment, none can intercede with Him on behalf of someone else and no one can make a recommendation before Him for someone without His Permission, -on nursing this set of beliefs -the possibility of sins which might be committed by him could be only either due to his inherent human weaknesses or his forgetfulness. And then such a person shall have been groaning under the burden of these sins, shall be utterly disgusted and shall not be able to raise his head (out of a sense of shame and remorse). This type of person is undoubtedly blessed with the mercy of Allah. As the amount of sins increases, so increases the intensity of his remorse and the more his remorse becomes intense, so does the mercy of Allah. We must remember the point that the sin of a devout monotheist can do what a virtuous deed of a polytheist cannot. A delinquent monotheist is a thousand times better than an observant and pious polytheist exactly in a similar manner as a criminal subject is a thousand times preferable to a toady mutineer, because the former is remorseful on his sin, and the latter proud and callous.

[1] Whether a 'Shirk' is of a monstrous nature or of a minor degree, is forbidden anyway and is contrary to the concept of Islamic Monotheism.

[2] Rabb means among other things, the Creator, the Sustainer, the Provider and the One in Whose hand is the disposal of all affairs.[I] Thus they confirmed to it. Then Allah elevated Adam (to a certain height) who could see all of them. he saw that there rich among them as well as poor, beautiful as well as ugly. Upon sighting this, Adam enquired of Allah, "O our Rabb! Why didn't You create all of them as equals?" He answered, "I like to be offered thanks." Then A dam {Peace be upon Him} sighted among them the Prophets {Peace be upon Them} too whose faces were glowing like lamps and who had an aura of illumination surrounding their faces. Then Allah the Exalted took also an acknowledgement from all the Prophets in regard to their Prophethood. It alludes to that pledge which is mentioned in the Qur'an with the following statement: (And there was also a time) when We took a pledge from the Prophets. These Prophets include you (Prophet Muhammad {Peace be upon Him} , Noah, Abraham, Moses and Jesus the son of Mary).

[3] It means declaring Allah to be the only God Who deserves to be worshipped in truth and confirming all attributes with which He has gratified Himself or that are attributed to Him by His Messenger {Peace be upon Him} .

[4] The purpose of mentioning this Hadith here is to clarify that committing an act of Shirk is an extremely obnoxious and abominable thing. One should not however, deduce that as long as one is free from Shirk, the commission of other sinful acts are in any way justifiable. In regard to the forgiveness of sins, one should take into consideration the general rule of Shari'ah (i.e., seeking Allah's forgiveness and becoming repentant).

Not Judging by the Book of Allaah:

A cause for calamities to strike the Ummah

By Shaykh Muhammad Ibn Jameel Zaynoo
Understand that judging by what Allaah revealed in His Book is incumbent upon the Muslim, and not doing so results an many calamities befalling the Ummah.
That there would always continue to be a group from this Ummah clinging to the truth and to the pure Tawheed of Allaah until the day of Judgment.
Allaah - the Most High - said:
“Say: Allaah has power to send punishment upon you from above you, or from under your feet; or to cover you in confusion with party strife; and make you taste the inter-fighting and violence of one another. See how We variously explain the Aayaat (proofs and signs), so that they may understand.” [Sooratul-An’aam 6:65]
Allaah’s Messenger (sallallaahu ’alayhi wa sallam) said, when this verse was revealed: “Say: Allaah has power to send punishment upon you from above you.” So he said: “I seek refuge in Your Face.” “Or from under your feet.” He said: “I seek refuge in Your Face.”
“Or to cover you in confusion with party strife, and make you taste the inter-fighting and violence of one another.” So Allaah’s Messenger (sallallaahu ’alayhi wa sallam) said: “This is lighter or easier.” [2]
The Prophet (sallallaahu ’alayhi wa sallam) said: “Indeed Allaah gathered up the earth for me so that I saw its eastern and western parts, and indeed the dominion of my Ummah will reach what was gathered up for me from it. And I have been granted the two treasures of gold and silver. And indeed I asked my Lord for my Ummah that it should not be totally destroyed by a prevailing famine, nor to allow on enemy to totally conquer it, except from amongst themselves. So my Lord said: O Muhammad! When I decree a matter, then it is not reversed. I grant to you for your Ummah that it would not be totally destroyed by a prevailing famine, nor will it be totally conquered by on external enemy, even if all the notions were to rally against it However, a group from your Ummah will destroy one another and imprison one another.” [3]
The Prophet (sallallaahu ’alayhi wa sallam) also said: “I asked my Lord for three things, I was granted two; but prevented from one: I asked my Lord that He should not destroy my Ummah with drought and famine, so He granted it to me. I asked my Lord that He should not destroy my Ummah with drowning, so he granted it to me. And I asked Him not to cause my Ummah to fight amongst themselves, but he refused that to me.” [4]
And this inter-fighting that has befallen the Muslims has been further emphasized in his (sallallaahu ’alayhi wa sallam) saying: “And when your leaders do not judge by the Book of Allaah, not seeking the good and welfare with Allaah has revealed, then Allaah would cause them to fight one another.” [5]
The Prophet said, in an addition to the second narration: “Indeed, what I fear for my Ummah are misguided leaders, and that when the sword is drown out against them, it will not be lifted from them until the Day of Judgement. And the Hour will not come, until sections of my Ummah will follow the mushrikeen (those who worship others along with Allaah), and until many sections of my Ummah will worship idols. And there will be in my Ummah thirty liars; all of whom will claim that he is a Prophet. But I am the last and the seal of the Prophets; there is no Prophet after me. And there will not cease to be a group from my Ummah being helped upon the truth, not being harmed by those who oppose them; until the commend of Allaah comes.” [6]
SOME BENEFITS FROM THE ABOVE AAYAH AND HADEETH:
[1]: It shows the great power of Allaah - the Most High – in sending punishment to the previous nations, from above them, and from beneath their feet, causing them to be annihilated and destroyed. Due to this, Allaah’s Messenger (sallallaahu ’alayhi wa sallam) sought refuge and protection in the Face of his Lord against his Ummah being punished in a similar manner.
[2]: The first hadeeth (narration) affirms that Allaah – the Most High – has a wajh (Face), but in a manner that befits His Greatness and Majesty, there being any tashbeeh (resemblance) between Allaah and between that of His creation; as Allaah said: “There is none like Him; and He is the all-Hearing, the all-Seeing.” [Sooratush-Shooraa 42:11]
[3]: It shows the great power of Allaah - the Most High - in that whenever the Muslims abandon judging by the Sharee’ah (Divinely Prescribed Law) of Allaah; but rather take to manmade laws that oppose the Law of Allaah - which, with deep regret, is happening now - then Allaah causes the Ummah to split-up into sects and parties, and makes them fight one another.
[4]: It Shows the might of Allaah in that He gathered-up the earth for His Messenger (sallallaahu ’alayhi wa sallam), so that he saw its eastern and western parts; and that the dominion of his Ummah would extend over all that which was gathered-up for him, from it.
[5]: It shows the mercy of Allaah to the Muslim Ummah, in His not sending against them a punishment that would totally destroy the entire Ummah; but it would only cause destruction to parts of the Ummah.
[6]: An-Nawawee (d.676H) - rahimahullaah - said: “In this hadeeth is a clear and apparent miracle, all of which has come to pass - so all praise be to Allaah.” [7]
[7]: It also shows the mercy of Allaah to the Muslim Ummah in that He has not allowed an external enemy to overpower them, such that they have complete control over them. Rather, Allaah has caused some parts of the Ummah to fight against others; and this is far easier than the former case.
[8]: It Shows the fear that Allaah’s Messenger (sallallaahu ’alayhi wa sallam) had for his Ummah with regards to the misguided leaders who would not take hold of the Book and the Sunnah; and how he warned against them.
[9]: That when the sword has been drawn out against this Ummah, then it would not be lifted from it until the Day of Judgement - as is happening at this very time now.
[10]: It proves that shirk would be present in the Ummah. And shirk is: Directing worship, or forms of worship, to other than Allaah, such as making du’aa (supplication) to other that Allaah, or judging by other than what Allaah has legislated and revealed.
[11]: We are informed about the existence of those who would claim that they are Prophets and that they are all liars in this claim; such as Musaylimah al-Kadhdhaab in earlier times, and in more recent times Ghulaam Ahmad Mirza, the Qaadiyaanee (whose followers are called Qaadiyaanees).
[12]: That there would always continue to be a group from this Ummah clinging to the truth and to the pure Tawheed of Allaah until the day of Judgement.
                          Imaam an-Nawawee - rahimahullaah - said:
“As for this group, then Imaam al-Bukhaaree (d.256H) said: “They are the people of knowledge.” And Imaam Ahmad Ibn Hanbal (d.241H) said: “If they are not Ahlul-Hadeeth (the Scholars of Hadeeth), then I do not know who they can be.” Qaadee ’Iyaad said: “What Imaam Ahmad meant by that was Ahlus-Sunnah wal-Jamaa’ah and whosoever holds the ’aqeedah (belief) of Ahlul-Hadeeth.” I say: It is possible that this group could be scattered amongst the various categories of Believers, from them:- the brave warriors, the Scholars of Hadeeth, the zuhhaad (those who abstain from the world in a praiseworthy manner), those that enjoin the good and forbid the evil, and other categories of people who do good.” [8]
Ibnul-Mubaarak (d.181H) - rahimahullaah - said: “In my view they are Ashaabul-Hadeeth (the companions of Hadeeth).” [9]
So the preferred saying is that this Aided and Victorious Group are those that act in accordance with the authentic hadeeth, not giving precedence to the saying of anyone over and above the saying of Allaah and His Messenger (sallallaahu ’alayhi wa sallam).

Ruling by Other than the Law of Allaah
                            Taken from ‘al-Qawl al-Mufeed `alaa
                            Kitaab at-Tawheed’ [2/263-269]
Translation by Abu Rumaysah [Triod Publications]
The following is taken from the Shaykh’s concluding remarks to the hadeeth of `Adee bin Haatim that he heard the Messenger of Allaah (SAW) reciting the verse,
"They (the Jews and Christians) took their rabbis and monks to be their lords besides Allaah."
                            [at-Tawbah (9): 31]

Upon which I said, "indeed we did not worship them." [The Prophet (SAW)] said, "did they not make unlawful that which Allaah made lawful and so you too did the same? [Did they not] make lawful what Allaah made unlawful and so you too did the same?" I replied, "verily." He said, "this then was the worship of them." Reported by Ahmad and at-Tirmidhee who declared it hasan.
[The following points] are derived from the hadeeth:
That obedience with the meaning of worship is a specific type of uboodiyyah.
Obedience in that which contradicts the Law of Allaah constitutes worship of the one obeyed. As for [obedience] in the worship of Allaah then this is [truly] worship of Allaah.
That following the scholars and servants in that which contradicts the Law of Allaah constitutes taking them as lords [besides Allaah].
Know that following the scholars or leaders in their making lawful what Allaah has made unlawful or the opposite [causes that person] to fall into one of three categories:
That he follows them while being pleased with their opinion and giving it precedence and being displeased with the ruling of Allaah - such a person is a kaafir because he has disliked what Allaah has revealed and as a result Allaah made his actions to be of no avail. No one but a kaafir has his actions rendered futile.
That he follows them while being pleased with the ruling of Allaah, knowing that it is the most ideal and best suited for the servants and the lands. However due to his following his desires he chooses this [other ruling] for example due to his [being offered] a position of responsibility. Such a person is not declared to be a kaafir, rather he is a faasiq.
That he does not know and neither is it possible for him to learn, so he blindly follows them thinking [that what he follows] is the truth. Such a person incurs no blame for he merely follows what he has been commanded and he is excused for this. This is why there occurs from the Messenger of Allaah (SAW) that he said, "indeed whosoever is given a verdict not based upon knowledge then his sin is upon the one who gave him the verdict." If we were to say that this person is sinful due to the error of someone else then this necessarily leads to oppression and difficulty, and no person would trust any other due to the possibility of bearing responsibility for that persons error.
                            {The hadeeth is reported by Ahmad (2/321, 365), Abu Daawood (4/66), ibn Maajah (1/20), ad-Daarimee (1/53) and al-Haakim (1/126) who said, "saheeh, meeting the conditions of the Two Shaykhs, I know of no defect [in it]." Adh-Dhahabee agreed.}
If it is asked: why are not the second category [of people] declared to be kaafir? I would reply: if we were to say that they are kaafir then this would necessitate the disbelief of every person who commits a sin while knowing that he has disobeyed Allaah and knows that [what he has contradicted] is the ruling of Allaah.
                            A Benefit:
Allaah has described those who do not rule by what Allaah has revealed with three descriptions:
"Whosoever does not rule by what Allaah has revealed then they are the disbelievers [kaafiroon]."
"Whosoever does not rule by what Allaah has revealed then they are the oppressors [dhaalimoon]"
"Whosoever does not rule by what Allaah has revealed then they are the sinners [faasiqoon]."
The People of Knowledge have differed concerning this. So it is opined that these descriptions in fact describe one and the same thing because the kaafir is a dhaalim due to the saying of Allaah,
"And the disbelievers are the oppressors." [al-Baqarah (2): 254]
[Similarly the kaafir] is a faasiq due to the saying of Allaah,
"As for the sinners then their abode will be the Fire…" [as-Sajdah (32): 20]
It is also opined that these are distinct descriptions and that they are [applied] in accordance to the situation:
So [one] becomes a kaafir in three circumstances
When he believes that it is permissible to rule by other than what Allaah has revealed. The evidence for this lies in the saying of Allaah,
"So is it the rule of Jaahiliyyah (ignorance) that they seek?" [al-Maa`idah 5: 50]
Everything that opposes the rule of Allaah constitutes the rule of Jaahiliyyah. [Also the evidence for this] is the definitive consensus that it is not allowed to rule by other then what Allaah has revealed. Therefore the one who considers it lawful and permissible to rule by other then what Allaah has revealed has contradicted this definitive consensus and such a person is a kaafir and an apostate. This [is similar to the case of one] who considers fornication or alcohol to be permissible or considers bread or milk to be unlawful.
When he believes that ruling by other then what Allaah revealed is equivalent to ruling by the rule of Allaah.
When he believes that ruling by other then what Allaah revealed is better than ruling by what Allaah has revealed. The evidence for this lies in the saying of Allaah,
"And who is better than Allaah in judgement for a people who have certainty?" [al-Maa`idah 5: 50]
So this verse states that the ruling of Allaah is the best of rulings as is further proven by the saying of Allaah, endorsing this,
"Is Allaah not the best of judges?" [at-Teen 95: 8]
So when Allaah is the best of the judges in ruling and He is the most just of the rulers then whosoever claims that the rule of other than Allaah is equivalent or better than the rule of Allaah is a kaafir because he has denied the Qur`aan.
                            [One] becomes a dhaalim
When he believes that ruling by what Allaah has revealed is the best of judgements and the most beneficial for the servants and the lands and that it is obligatory to apply it. However hatred and jealousy lead him to rule by other than what Allaah revealed over his subjects - such a person is a dhaalim.
                            [One] becomes a faasiq
When he follows his own desires. For example he rules in favour of a person due to being bribed by him, or due to his being a close relative or friend, or [because the ruler] seeks the fulfillment of a need from his comrades or the likes. This along with the belief that the rule of Allaah is the ideal and it is obligatory to follow it - such a person is a faasiq. Even though he is also a dhaalim, describing him as a faasiq is more befitting.
The strongest opinion is the second that these descriptions are distinct and that they are [applied] in accordance to the situation.
As regards the one who lays down legislative laws, despite his knowing the judgement of Allaah and that these laws are contrary to Allaah’s judgement - then this person has substituted these laws in place of the Sharee`ah. Therefore he is a kaafir - this because he does not choose these laws and turn away from Allaah’s Sharee`ah except due to his belief that they are better for the people and the land than the law of Allaah. But when we say that he is a kaafir, then the meaning of this is that this action leads to disbelief.
However the one who [legislates these rules] may have an excuse - for example he may be one who has been deluded: such that it has been said to him that this does not conflict with Islaam, or that it is something allowable as a case of benefiting the people (masaalih al-mursala), or that it is something that Islaam has left up to the [custom of] the people.
So there are some scholars - even though they are in error - who say that social transaction (mu`aamalaat) is something not dealt with by Islaam, and that rather it is referred to whatever is found to benefit the economy in each particular time. So if the situation requires us to establish usury banks or to tax the people then there is no problem with this.
There is no doubt concerning the error of [such a claim]. So if these people performed ijtihaad then may Allaah forgive them. Otherwise they are in a situation of very great danger and it is befitting that they are entitled ‘scholars of the state’ and not ‘scholars of the Religion.’…
