KABUL (Pajhwok): A number of political experts say acting foreign minister, Salahuddin Rabbani, has clearly violated the law while serving the interest of his Jamiat-I-Islami Afghanistan (JIA) party instead of the government.
Three days back, Rabbani had said he would attend the Kabul Process conference, if allowed by the party. Representatives from 25 countries and international organisations attended the event at the Ministry of Foreign Affairs (MoFA) on Tuesday.
The Kabul Process is aimed at stepping peace and reconciliation efforts and the counterterrorism campaign. The meeting was held in the absence of the acting foreign minister.
A number of political observers called the absence of Rabbani a clear violation of the law and demanded his punishment. Article 80 of the constitution says ministers shall not use their positions for linguistic, sectarian, tribal, religious or partisan purposes.
Political commentator Mohammad Hassan Haqyar said the law was usually applied to the civilians. The minister’s absence from the Kabul Process meeting was a clear violation of law, he reiterated.
The international community should support Afghanistan in law enforcement so Rabbani is suspended and introduced to the attorney office, he suggested.
Former Wolesi Jirga member, Abdul Kabir Ranjbar, told Pajhwok Afghan News the acting foreign minister had breached by placing party interests over government's. He wants Rabbani to be sacked.
“Rabbani was disqualified by the Wolesi Jirga six months ago; he should have been fired at that time. But the government did not take action against him,” the ex-MP noted, who wanted the minister to be treated under the law.
A political science lecturer at Kabul University, Wadir Sapi, held a similar view and said Rabbani should be shown the door to uphold the rule of law.
“It is unacceptable Rabbani leads both his party and the Ministry of Foreign Affairs at the same time. He has appointed his own people to the ministry. The government should not remain silent ,” he added.
Another political analyst, Javed Ghafoor, accused Rabbani of pursuing partisan interests and trampling on the national interest. “This act shows that only personal interests, not national gains, are valuable to him.”
Ghafoor called Rabbani's stance against the Constitution, demanding his punishment in compliance with the law.
Article 78 of the Constitution says: “If a Minister is accused of crimes against humanity, national treason or other crimes, the case, in accordance with Article 134, shall be submitted to a special court.”
A civil society activist and political commentator, Mohammad Noman Dost, agreed the acting minister had violated the Constitution and he should be at least suspended.
“Law is law, which should be applied equally to all people. Even if Rabbani hasn’t read the Constitution, it should not be considered an excuse.” Article 56 says: “Ignorance of laws shall not be considered an excuse.”
A public representative from Badakhshan , Amanullah Paiman, said based on the parliament’s viewpoint, Rabbani had been impeached long ago.
He should have been dismissed by President Ghani and another individual should have been introduced to the Wolesi Jirga for a vote of confidence.
“Rabbani has violated the law, but the president is even more blame worthy than him for not applying the the law to the minister.” But Paiman explained Rabbani had made the remarks noy as a foreign minister, but as JIA head .
A central member of JIA, Hafeez Mansoor, refused to say anything in this regard, suggesting Rabbani himself be asked about it. Pajhwok tried to establish contact with Rabbani, but in vain.
After remarks from Rabbani, some people have erected protest tents on roads, creating problems for citizens. The government said on Wednesday the camps should be removed from roads.

Rabbani has clearly breached the law, claim experts — Governance & Politics, Pajhwok Afghan News

Don´t worry about him. No one can replace him from the ministry unless he himself wants to leave. Every try to replace him is ethnic motivated. It became clear when he was summoned and he proved that he spent more than 73% of the Ministry´s budget and yet some bought MPs wanted him to be placed. If he leave he will announce Badakhshan independent and then more provinces will follow and people like you would become hunted as terrorists in those provinces. Keep in mind what currently is happening in Herat. People are getting armed and ready to kick unwanted groups out of their province and city. Junbish Mili and Jamiat Eslami are going to fusion...what will you do? I well remember when you wrote Ghani is using Uzbeks against Tajiks very well while you were laughing. Ask the Naqleen population today if they still want you laughing

What language are you speaking? I honestly don't understand what you're saying or even more importantly, what the heck is going on in your head... do you have schizophrenia by any chance? I am not making fun of you, I am dead serious.

If anyone can please explain what he is talking about in his posts. I will highly appreciate a normal person explaining it to me. I have met many different people and I would have called this guy fascist, but it seems like he is not, rather... how should I put without insulting, mental? Don't misunderstand me, I am not trying to insult him, but I honestly think he has some mental issues.

This is a NA/NUG deal demand. Places in govt are politically allotted under a flimsy veil of American aegis. Every party and topaksalars wants their share of the loot that really belongs to the nation. NUG working hard in earnest is seen from otherside of the coin; a mirage to show serious work is being done so the loot(aid) keeps flowing.

As for 'rabbani will leave only when he wants', that's is classic tough talk tantrum, separating vilayat badakshan or any other is threatening the gang with demand of their share. Saleh's pique is natural, as the old adversary is before all of the panjshiris. Pieces fit well in the jigsaw.

It's the pailooch who will not compromise in this charade.
