  • Humiliating: IDPs returning to Waziristan required to sign 8-page loyalty agreement

PESHAWAR: The people of North Waziristan have been required to reaffirm their allegiance to the Constitution, Frontier Crimes Regulation and local customs, by signing an undertaking under the “Social Agreement North Waziristan 2015”.

The agreement seems to be questioning the loyalty of around five million people of North Waziristan to Pakistan. In addition, the tribal people are also bound by virtue of the agreement to show loyalty to FCR, which means that they will never oppose the colonial-era law.

“Being responsible citizens of Pakistan, we will remain loyal to the country at any cost and will abide by the Constitution, FCR and customs. Moreover, we will play a positive role for the development, prosperity and security of Pakistan,” says the undertaking attached with the agreement.

“You will not become part of any action intended against peace and security of Pakistan and will prevent enemies of the state, Constitution and institutions or local and foreign terrorists from using your soil against the country,” it says.

Around one million internally displaced persons will have to sign the undertaking before returning to their homes. The people in Razmak and Datakhel subdivisions who were not evacuated in the wake of operation Zarb-i-Azb have also been handed over copies of the agreement and asked to sign it within three days.

The people of the tribal borderlands are used to reiterate their allegiance to the state whenever top dignitaries from president to political agent address a jirga.

But this time, signing the undertaking for showing loyalty to the state and Constitution is prerequisite for every displaced family of North Waziristan before returning home.

The eight-page social agreement, containing 18 main and 16 sub clauses along with the undertaking, has been handed over to the elders of Utmanzai Wazir, Dawar, Saidgi and Kherseen tribes of North Waziristan.

The displaced people are required to reaffirm their allegiance to Constitution before going home
The political agent on behalf of Khyber Pakhtunkhwa governor and federal government has been declared the first party and four major tribes of North Waziristan are second party to the agreement.

If a tribe fails in fulfilling its responsibilities mentioned in FCR, then the government will withdraw all incentives of the tribe or clan including cancellation of national identity card, passport and other documents. Their properties including houses would be confiscated or demolished or they will be barred from the area. The people would be responsible for maintenance of peace, security of the government bodies and action against anti-statement elements.

The government institutions have been given secondary role in this regard although according to the Constitution protection of lives and properties of citizens is the prime responsibility of the state. The people in Razmak and Datakhel areas have already received copies of the agreement. Mir Kalam Khan, a local elder, said that in the absence of political administration field commanders had asked people to sign the undertaking within three days otherwise there would be no supply of food rations for the local people.

“People are forced to sign the document which is very unfair,” he said, adding that senior officers of the army were holding jirga with the elders in Razmak, Dosali and Garyum.

The elders of four tribes, who had assembled in Bannu last week, opposed the agreement. They were adamant not to sign it. They wanted the government to take them into confidence before implementation of the agreement.

An elder said that another jirga was likely to be held to make a final decision in that regard. “The contents of the agreement are ridiculous which give impression that our children will not go to schools. People will always protect state properties only,” he said.

Senior government functionaries insisted that the agreement was based on FCR under which people were bound to fulfil their collective and territorial responsibilities. An official said that the agreement handed over to the tribesmen was not negotiable and compulsory for every family to sign it before going back to their area.

“The agreement has been framed within the framework of FCR which is law of the tribal area and no additional condition has been included in it,” said the official. He added that the IDPs, who would return to their homes in North Waziristan, had already signed the agreement. Return of the 18,000 displaced families would start within next few days.

The agreement says that there will be ban on heavy weapons and people will keep small weapons that will be registered with the administration. Another clause of the agreement says that protection of the government institutions will be responsibility of the tribes which has worried the local people. The tribes would set up peace committees in their respective areas to keep their soil free of anti-state elements.

According to the undertaking, if people fail in fulfilling their responsibilities then the government institutions will be at their liberty to take action against miscreants. The tribes would not claim compensation in case of damage occurred during the action.

Mir Kalam said that the government on the one hand was giving responsibility to the local people to maintain peace and set up peace committee to eliminate criminals while on the other hand they were being disarmed. An official clarified that tribesmen would have to bring activities of anti-state elements into the notice of administration and then the government would take action against them. “People don’t need to keep heavy weapons or fight against criminals. They will just inform the administration,” he said.

What? It was the army and the ISI that supported militants in the area for decades, pumping billions of dollars into the madrassas and sending fighters into Afghanistan, while also allowing drone strikes which radicalized the population. Why do the locals there have to be held accountable for the actions of the establishment? I'm happy the tribes have refused to sign this stupid contract.

In the copy of agreement that i have read, it is written that government will cancel their national identity card, passport and other legal documents if they violate loyalty agreement................Keep in mind state cant do this with "proper" Pakistanis no matter how much disloyal they are. It is clear that Pashtuns of FATA are not treated as equal Pakistanis, their status is worst than red indians. Imposition of FCR and following it, is main condition of this loyalty agreement. Funny thing is, tribals wont be compensated for the losses in military operations in this agreement, which itself is violation of FCR.

Why Faqeer of IPI and Afridi's Sarishta failed? we need to study that part of hsitory

            - The Pakistan project is a tenuous and precarious one which it is felt could easily collapse at any moment, this feeling only heightened and reinforced by the 1971 disaster.

            - As this project, "Pakistan" (greater Punjab) is relatively fragile the Pakistani army are vigilant against all threats which include the external threat of India obviously but also internal threats.

Any internal "threat" (as labelled so by the Pakistani Punjabi army) could have huge consequences in their eyes and so such people must be termed "traitors" (ghaddars) and must be kept a close eye on and dealt with strongly.

            - So pre-71 when Bengalis, who were actually Pakistan itself as most Pakistanis were Bengalis, were called traitors by the ruling elite of the western wing whenever they voiced demands for their rights.

            - In and post-71 they were and still are called traitors, the only moment in history when the majority of a country are called "traitors" by the minority.

The Pakistani army is a Punjabi army.

The Punjabi "Muslim", has no history of state or empire, the only thing he has is Pakistan.

So he will struggle to maintain this with all his power.

The Pakistani Punjabi army does not view non-Punjabis as real Pakistanis, so these "Pathans" of FATA, are disobedient "Pathans" who must be tamed and civilized.

They are not victims, they are not people who have lost their homes and had their lives are destroyed but they are a pest, a burden, a potential threat.

The Muslim card is used by Pakistanis/Punjabis for Palestinians and others, but it doesn't apply so much for non-Punjabis.

However the Muslim card is swallowed by non-Pakistani Muslims including Arabs and Turks, all of whose regimes adore the Pakistani state and are indifferent to the suffering of Pashtuns, Baloch, Bengalis etc, whose Islam and "Muslim-ness" is temporarily suspended when these Arabs and Turks speak of Pakistan, turning a blind eye to its many atrocities.

            * * *

As for the poor people of Waziristan and FATA, what can I say?

What choices do they have? Who will help them?

The Pakistan army does not rule for the sake of Pakistanis, it rules for the sake of an abstract non-physical "Pakistani" (Punjabi) nationalism and phallic desire for status and glory.

Glory for a people with no history.

Pakistan is actually greater Punjab comprising Punjab proper, Kashmir, and regions in Hazara. What they are doing would not go unpunished. But it is not they alone having done it. They have been supported by super powers with military aid and money. It is a true rent-ier state. Punjabi Army is the ******* child of the British Raj.

Where the heart is: IDPs hesitant over return amid controversial ‘social agreement’

                  BANNU / PESHAWAR:
As residents of North Waziristan make their way home today, it is under the heavy shadow of a set of draconian conditions set by the political administration. In fact, for some of them, the only thing standing in their way home is actually signing off on Samaji Mohada NWA 2015, the eight-page ‘social agreement’ that some feel not only questions their loyalty, but effectively further enforces the oppressive Frontier Crimes Regulation (FCR).

The political administration completed the registration process to repatriate dwellers of three villages of Spinwam. The process will begin from March 31 (today). Around 1,270 families have been registered for repatriation so far. Sources said the returning IDPs were still uncertain over their return. They added around 100 families would return home on March 31 from the IDP camp in Bakakhel.

In addition to the FCR, the social agreement lays out more conditions which must be fulfilled. While it says there will be no restriction over social, religious, political and economic activity, it adds that natives of the region will have to remain loyal to the country in accordance with the FCR and Constitution of Pakistan. It goes so far as to withdraw the right to compensation if the government takes action in areas where tribes fail to act against militants.

In addition, several actions on part of the tribespeople can result in the retraction of tribal privileges, cancellation of NICs, passports and other official documents, the confiscation of property and even the banishment of the person and the destruction of their property.

For all intents and purposes, signing the eight-page document would make locals responsible for maintaining peace in the tribal agency. It asked tribespeople to ensure that nobody provides shelter to anti-state elements, militants and other criminals, adding that the political administration must be informed about the presence of such individuals. It also bars them from keeping heavy arms at home.

                  Signing off

According to a document available with THe Express Tribune, the political administration and the Wazir, Dawar, Sidgai and Kharseen subtribes of the Utmanzai tribe came to an agreement.

According to the agreement, the various responsibilities will apply to returning tribesmen as well as those already living in Dattakhel and Razmak subdivisions as well as other areas of Spinwam.

Tribal elders had already expressed their reservations over the social agreement which was issued by NWA Political Agent Atifur Rehman and distributed in Razmak subdivision, Dattakhel and to displaced people in Bannu. The tribes have asked for a meeting with authorities as they have reservations over the agreement.

                  All in favour…

The people in Razmak questioned how the Utmanzai Grand Jirga could reach an agreement without taking them into confidence. However, the jirga remained unaware of the agreement until tribesmen came forward with their reservations. Tribal maliks in Dattakhel, who were not displaced by Zarb-e-Azb, signed the agreement in the presence of the NWA political agent and security forces officials. The elders who signed the agreement included Malik Mushtaq, Malik Roshad, Sobidar Ahmad Gul, Malik Fazal Janan and several others. They vowed to remain loyal and fulfill their responsibilities of maintaining peace in the region. However, the Utmanzai tribes were not convinced and elders of displaced people in Bannu also had reservations.

Malik Khan Marjan, an elder of the Grand Jirga and an IDP, questioned whether the agreement was between two or more groups or imposed by one on the other. He questioned when and where the four tribes agreed over the eight-page document with the political administration.

He urged the government to convene a jirga of North Waziristan elders over the repatriation process. Marjan said certain tribal elders would find it difficult to reach an agreement over the document unless they sat with the government on their own.

Another tribal elder, requesting anonymity, said security forces should start the repatriation process once they are certain peace has been restored in the area. He said if locals were capable of keeping the agency tranquil, they would not have left in the first place. Several attempts were made to contact political administration officials to discuss the concerns of IDPs, but they remained unavailable. Prime Minister Nawaz Sharif and Chief of Army Staff will also reportedly come to Bannu to bid farewell to the displaced people. (With additional input from NasruMinallah)

This anger is because Pakistan wont be making money out of NATO supplies and drone strikes after US exit.

Recently, Raheel Sharif has gone to Washington two times to request that Obama reconsider his decision for full US withdrawal. He tried to meet with Pentagon leaders, thinking they could reverse or undermine Obama's decision. However, he and they were unable to change the decision. All he got was a superficial promise that US will continue CSF (Coalition Support Fund) payments after withdrawal, but that means nothing and was not put in writing. Nawaz and Ghani both tried to do the same, but also came up short.

Pashtuns in Pakistan have no obligation to Pashtuns in Afghanistan. So save your pride and honor by stopping yourself in leeching to them.

Pashtuns in Pakistan being treated unfairly isn't some news. It happened before, it happens today and it will happen in the future. This by no mean means that they have some obligation of loyalty toward Afghanistan. Everyone is the master of their own fate and if they feel happy in Pakistan, then you have no right to claim over them. To sum it up, they have betrayed no one.

And in which moral high ground do you or the Afghan people stand... Afghanistan is a mess, and yet here you're clinging like a leech to people you shouldn't be clinging to.

Brother, don't take this as an insult. I am just tired of people not prioritizing. The truth must go out, one way or another.
Don't quote me or speak to me if you hate Afghanistan, you be ignored.

People with identity crisis will be ignored as well.

They have no obligation to help, but they do have an abligation not to destroy and spread extremism in to the neighbouring country that comprise their own ethnic group.
Even today Pashtuns from KPK come to Afghanistan to destabilise the nation and plant boms, becuase Afghans are so called kafir, meanwhile in Punjab you have ***** houses next to a mosque. But they are kept save.

I have no symphaty or what so ever for this people, after the terror atack in the Peshawar school they treaded Pashtun and Afghans like subhumans, when no Afghan was involved in the atack. And they still look down up on Afghans and discriminate them.
