  • Man-Made Laws vs. Shari'ah

This book appears at a time when many other books and ideas are being propogated to justify the status quo of the ummah, and the position of those who are not ruling by what Allah has revealed and to detract from the seriousness of the situation.
This book is a detailed discussion of the extreme views of both the Murji’ah and Khawaarij, which are clouding the ummah’s vision as they have done for far too long. The view of the Murji’ah states that faith is simply the matter of belief in the heart, which no link to action, whilst the view of the Khawaarij is that any sin equals a mjor kuft act which puts a person beyond the pale of Islam. The author highlights these distorted views, then explains the middle way of Ahl as-Sunnah wa’l-Jamaa’ah, based on the Qur’an and Sunnah, where faith is composed of both belief and action, and it may increase and decrease; while sin does not necessarily equal a major kuft act, but there are some major sins which do consitute major kufr acts and put a person beyond the pale of Islam, such as ruling by something other than what Allah has revealed.
Once this idea is clear in the minds of ordinary Muslims, the Muslim ummah will not accept anything from their governments and rulers except shari’ah, to rule their lives, and they will realize that any other system or law is nothing more or less than kufr in disbelief and a deviation from Islam.

Those man-made laws are required because people will use Sharia to take advantage of people. When sharia law is used in the government, they won't use the correct way for trials, or anything. They will only use sharia law only when they want to. And sharia law is even more harsh than man-made laws. If we have someone reliable, like how the Prophet(pbuh) was, then that is the only way Sharia law will work. anyone else besides him can't keep it equal.

So basically you are saying we should all become kaafirs because Prophet Muhammad sal allahu alayhi wasalam is no longer alive to adminster justice and without his presence all of Islamic laws are void?

Great. You should become a politician.

Sharia is also a man made law. Difference between secular laws and religious laws is that secular ones are based on reason while religious are based on fairy tales from 14 centuries ago.

Just please prove me that Sharia is God-made law.

That's not entirely true, secular laws are often based on cultural ideals, for example from a Utilitarian perspective it would be reasonable to kill the handicapped and the poor/unemployed (That is if they have no useful skills) as they produce stresses on our resources. This would be logical and rational yet society would object to this and laws prevent this.

Likewise you can argue that the religious laws, often harsh, stem from an evolutionary model that people adopted to siphon out or restrict the behavior and influence of people whose lifestyles were deemed disruptive to the greater fabric of society.

It's not simply this false dichotomt you present.

If those cultural ideals are against reason then they should be rejected. As far as I know most of european countries don't allow irrational laws.

Anyway please prove me that Sharia is not a man-made law. I think you are a reasonable human being. Please prove it through reason.

But they're not rejected, Secularism ans Reason are not the same thing and Religion and Reason are not at odds.

My point was you made a logically fallacious claim.

Well proofs require rigor, so for me to give you that type of rigor is outside of my ability as I can not show you N or N+1 cases where something cannot be explained by some anthropogeneic argument.

I will say however, that Many of the religious laws are more consistent with how we evolved as a species and since that would be the deciding factor in laws rather than cultural attachments as you may find in most secular legal framework. That would make it no longer man-made thereby demonstrating the Plausibility that Shari'ah is not Man-made. But that's the best I can do since I cannot give you Absolute rigor since that would take a time-span any human is currently incapable of.

I disagree with your point of view.. but at least you use your brain. You can not prove it and I can not change your point of view nor I want.

                  Keep it up.

I like when blind, deaf and dumb people think Islam and sharia are "fairy tales". The Qu'ran talks about you losers; you guys put the coal, the propane, for the fires of hell to burn.

You people act like how the Israeli's did when Musa took a long time meeting god on Mt. Sinai.

you people act like how the people of Thamud did when they asked Saleh for proof of god. he brought them that she-camel yet they killed it.

also, the people who mocked at Noah for building a boat.

                    etc,

so do us all a favor and continue disbelieving in "fairy tales"

sharia include both man made and quranic laws. who was prophet mohammad, wsnt he a man? there are still situations that couldn't be resolved by quran and hadis then the scholars makes the decision.

Quran also says that sperm comes from your kidneys. And according some hadiths camel urine is good for your health.

Imam Jalal al-Din Suyuti reports from Tabarani and Bayhaqi who narrate from Hukaymah bint Umaymah (May Allah be pleased with her) with an authentic chain of transmission, she said, 'the Prophet (May Allah shower peace and blessings on Him) had a wooden bowl in which He used to urinate and was placed under His bed. One night, He searched for it but did not find it and asked for it saying, ‘where is the bowl?’ The members of the house replied ‘Umm Salamah’s slave girl Barrah drank from it’ who came from Habashah with her. The Prophet replied, ‘surely she has protected herself from the fire with a great wall’’'

The more uneducated the more religious. Afghanistan is one of the most religious countries in the whole while european countries are most secularist ones..

Average literacy rate in the world: 84,1%
                          Afghanistan´s literacy rate: 28,1%

                          You uneducated fools LOL

As far as I know we do not rely on such ahadith in the first place and the hadith about drinking camel urine was about people who became hypocrites and murdered others. No indication that this was a general prescription.

as for Afghanistan and literacy rate. There are secular countries with lower literacy rate. Burkina Faso is a secular state with a lower literacy rate. Afghanistan is the only country considered an Islamic State or Islamic Republic that ranks in low literacy. Mali, Chad, South Sudan, etc are all Secular states. These states were also colonized by Europeans and sacked or exploited

Where as Europeans who are the Wealthiest, Namely Britain, Holland, France and Germany are among the wealthiest were all previous colonizers. So your argument is lacking a full complete understanding, you're simply cherry picking random information without ghiving any relevant or appropriate context.

Between man-made laws and Quranic/Shariah-based laws most Muslims would argue that the latter is better. Why opt for changing man-made laws when the divine is infallible? However even Sunnah-based Shariah is down to human interpretation and there are many instances where this is highly selective. This is an obvious sticking point because even Shariah can be made to appear seasonal/man-made.

Elsewhere on the forum approaches to Shariah have been discussed though in general people don't like being told what to do. How do we reconcile that aspect of human nature?
