The Afghan Fact Sheet, after months of research came across a treasure-trove of information about Dr. Abdullah Abdullah’s criminal case. Recently, a popular French magazine [Le Nouvel Observateur] published an article - 05 December 2013 about Dr. Abdullah’s criminal activities and his flowed character that has been artfully kept concealed from public.

In the midst of criminal charges filed by Dr. Abdullah’s wife in Afghanistan before the Afghan Independent Human Rights Commission (AIHRC) and the Attorney General Office (AGO). Both institutions have summoned Dr. Abdullah, before which, he admitted to all charges stipulated in the complaint. Lack of political will among the Afghan leadership — exacerbated by tremendous reach of criminal elites across the governmental institutions, made the prospect of any investigation nearly impossible. Dr. Abdullah, therefore, successfully used his traffic of influence to hush Dr. Sima Samar chair of AIHRC, Mr. Ishaq Aloko Attorney General of Afghanistan and the local media outlets.
Two years on, Abdullah seems nonchalance about any kind of legal apprehension in Afghanistan. With his above the law attitude –where the networks of criminal elites are the main obstacle for implementation of the rule of law and access to justice in the post-conflict country - Abdullah enacts a public image full of ethics and morality. His far-fetched audacity to advocate for human rights, justice and rule of law, is mind boggling not to mention his temerity - running in 2014 presidential elections. All this should be alarming to Afghans and their international partners trying hard to rebuilt Afghanistan with [blood & treasure] hoping to institutionalize women’s rights, rule of law and the prospect of a better future for all Afghan citizens.
The quest of a married man for love
In April of 2010, Dr. Abdullah Abdullah the former Afghan minister of foreign affairs travels to Nice-France, for the realization of his long awaited scheme, to ask for the hand of a young beautiful and educated Afghan diplomat Mariamme Nadjaf, in marriage. As it is customary in the Afghan culture for a man to obtain the bride’s parents consent prior to marriage, Dr. Abdullah therefore, travels to Nice – France, where Mariamme’s family reside. He expresses love and admiration for her, literally weeping to convince her family to marry-off their daughter to him. At first, Mariamme’s mother was unhappy to give her young daughter to an old married man with four children. But Abdullah knew in advance - what to say and how to persuade them -- in order to gain their trust. He talks about his marriage with Fakhria stresses it is a complete failure and started as a “political & symbolic” union – moreover, there is nothing between them anymore. Abdullah assures, he has been living apart from Fakhria for years and proclaims: “his divorce was imminent”.
In April 2011, Dr. Abdullah arranged secretly his matrimony with Mariamme in Dubai, UAE, where he had only invited two of his very close friends as witnesses (Abdullah Mujadidi and Abdul-Rahim Hashimi), and the third individual invited by Dr. Abdullah was the Mullah-Imam (Haji Yaseen) who proceeded with the Nekkah.

The secret marriage agenda of Abdullah, in itself is a testament to his immoral and unethical behavior -additionally his disregard for the sanctity of marriage, where verses of Holy Quran is recited to join two individuals in the most legitimate way possible before God. Only a morally sick man [married with children] like Dr. Abdullah Abdullah would go to that extent to marry for second time with deceitful intentions and try to hide it from his wife and children. Playing with the life and honor of young girls for Dr. Abdullah and his friends seems like business as usual.
Covering Crimes
Evidently, marriage and divorce is a common civil matter, especially when it is consensual between adult couples. But in Mariamme’s case, the issue is no longer a civil matter, it is criminal - Abdullah Abdullah brazenly used violence and intimidation (direct death threats and psychological intimidation through former chief of NDS, and menacing phone calls) to silence Mariamme which led her to forced exile from Afghanistan. Abdullah Abdullah was ready at any cost to conceal his immoral deeds and criminal actions from public, to safeguard his faux prestige and public image. Moreover, he used his political influence to bypass the law and administrative hierarchy (i.e. issuing a fake divorce certificate on behalf of Mariamme with fake witnesses and testimonies from the Afghan Supreme Court.
Furthermore, AIHRC and AGO heads personally obtain Abdullah’s confessions to all stipulated violations but for unknown motives didn’t pursue the case) thus, preventing Mariamme to have access to justice in Afghanistan. To-date, Abdullah still holds Mariamme’s belongings; [her cloths, money and jewelry] in addition; he disregards his legal and Islamic obligation as a spouse to pay her dowry after divorce.
Justice is finally catching-up with Dr. Abdullah; the French Court seriously pursuing the case. The Human Rights Commission & Judicial system in Afghanistan regrettably failed to fulfill its mandates to preserve and protect the rights of Mariamme and thousands of Afghan women and girls that are suffering from social inequities on daily bases.
The love struck married man
Dr. Abdullah Abdullah’s first encounter with Mariamme Nadjaf occurred in 2003, during his official visit as the Minister of Foreign Affairs of Afghanistan, at the UNESCO General Assembly in Paris France. Abdullah was mesmerized by Mariamme and ever-since sought to maintain contact with her. The young and vibrant Mariamme with graduate degrees in international law and diplomacy joins President Karzai’s economic advisor team in late 2004 in Kabul, working on Afghanistan National Development Strategy ANDS and Millennium Development Goal MDG. After successful completion of her assignment in 2006, she was offered the post of first secretary to the United Nations Permanent Mission in New York. Dr. Abdullah, who was removed from his position of foreign minister by President Karzai few months later, becomes relentless with his calls, changes the nature of his professional rapport with Mariamme to that of a confidant - complaining about his marriage and difficulties with his wife Fakhria - gradually increases the frequency of his calls.
In 2009, prior to presidential elections, Dr. Abdullah demands Mariamme to come to Kabul and assist him with his presidential campaign. She complies and it was then when Dr. Abdullah takes the leap and declares his love and admiration for her. The audacious declaration of Abdullah astonishes Mariamme and she replays: “I do not want to destroy a married man’s family and moreover I am not the kind of girl to be in an illegitimate relationship.” Abdullah reiterates: “I thought I made it clear to you over the years that I was living apart from my wife and our divorce was imminent – I love you and I want to marry you.”
In April 2010, Dr. Abdullah went to Nice - France to meet with Mariamme’s family and to ask them for her hand in marriage. He finally convinces her family. In April 2011, Dr. Abdullah Abdullah secretly marries Mariamme in Dubai, in a private ceremony where only her parent and Abdullah’s close friends are present.
After the ceremony, Abdullah tells Mariamme to move to Kabul - he arranges a house and provides her with security from his private security personnel. During her stay in Qalahe Fatolla, Abdullah was invisible, cautious that people might find out about his secret marriage in Kabul.
While traveling outside Afghanistan, Abdullah plunges on shopping sprees, trying to impress her by spending thousands of dollars on lavish accommodations and very expensive garments. Abdullah slowly reveals is true character as the effect of alcohol makes him more honest removing his incognito veil, talks about his mistresses and his unshakable ties with Iran. Abdullah only loved to be with Mariamme while traveling outside Afghanistan, a behavior she found worrisome and questionable.
Based on her husband’s insistence, Mariamme lived in isolation under difficult and unpleasant condition in Kabul. Abdullah’s fear of leakage of the marriage causes enormous pressure on her, keeps her away from work and close friends. Her days go by with emotions while waiting to start a normal life. Abdullah spends hours on the phone with her new bride every night assuring her “I am working to finalize my divorce soon.” He demands her patience and perseverance, indicates this is a temporary situation.
June 29, 2011 he says to Mariamme, “my wife agreed to divorce, she is leaving for London with our kids soon.”
Interrupt
The news of Abdullah’s marriage reaches his first wife through a mistress of Abdullah [Freshta Hazrati] that lives in Sweden. June 30, 2011 in the evening, Fakhrya calls to congratulate Mariamme in a deceitful manner. During that call, Abdullah takes the phone and urges his new bride to come over his house in Kartai-Parwan. His unusual tone of voice and the deafening quiet of his first wife next to him compounded with irrational urgency to come to his house in the middle of the night put Mariamme in a very discomfited state. A disturb feeling of fear gushes through her and she feels isolated. Persistent ordering of Abdullah: “if you are my wife you would come now!” is utterly disturbing, she feels a direly unpredictable situation awaits her. He sends a car late at night to pick her up with two armed guards and his nephew.
When she arrives there, she finds herself in a threatening situation surrounded by Abdullah’s armed security personnel. When she enters the house, Abdullah, his wife Fakhrya, his daughter Laily, his brother, and his brother in law, were sitting in the backyard. Out of respect, Mariamme greets and offer to shake their hand; no one shakes her hand including Abdullah, except for his brother in law.
After she sits down, Abdullah starts his speech with a serious tone and before everyone says: “For the first time I will tell the truth, I was forced to marry Mariamme and the promises I made to her were lies.” Meanwhile, the upset wife starts to insult her with horrific accusations, orders Abdullah to tell her! And he looks at Mariamme and mentions the word “divorce” three times. She orders Abdullah “tell her from now on she is like a sister and mother to you” and Abdullah reiterated the exact words. They ignore the fact that Abdullah pursued her for years and moreover he went to France begging for her hand in marriage. Unfortunately, in the backward Afghan culture, contrary to Quran, accusing the female victims or the weak is pervasively common practice to cover the malfeasance of powerful male perpetrators.
They threaten her to leave the premises and warn if you utter a word about all this, your life and that of your family will be at great risk.
She leaves in state of shock completely loses her trust in Abdullah and feels her life is in danger. At the first crossroads, she opened the door, runs to a friend’s house where she takes refuge. Soon she demands her to leave for fear of retaliation. Mariamme checks-in Serena Hotel.
Few days later, a call informs her that the former chief of intelligence NDS wants to meet her. Abdullah sends his close friend and confidant, the former chief of intelligence to meet with her. In that meeting, the official’s behavior was utterly disrespectful, far from morality and principles of decency that Mariamme has ever encountered. He among other verbal threats says: “What do you want? How much money do you want to keep your mouth shut and mind your own business? You are no longer the wife of Dr. Abdullah, you are divorced, you must accept this [verbal] divorce you have no choice!” Then continues to charm her: “You are still young think about your future. Even if you continue to pursue this, no one will take you serious, in three months, your claims will no longer be worthy of consideration, not to mention the great risk you will face…. Dr. Abdullah doesn’t have to explain or give any reason for divorcing you. You don’t have the right to ask for explanation. You must accept it without any conditions. If you go to the court or before media, you are making a huge mistake. If you were the wife of another warlord by now you would have had several bullets in your head and no one could have found your body, you know, you are very lucky!” After repeated threats, at the end, he issued a final warning and accuses her: “If we find-out that you were sent by a foreign spy agency to undermine Dr. Abdullah, you will face dire consequences.”
In the following hours, on Mariamme’s mobile, various voices threaten to throw acid on her, to rape her before throwing her in the gutter. They exert overwhelming psychological pressure on her in Kabul and her mother, in Nice, is flooded with anonymous calls: "Don’t let your daughter to ever put her feet on Afghanistan’s ground, otherwise ...
The former head of Afghan intelligence summons Mariamme for the last time: "How much do you want to shut your mouth? Despite the risk, Mariamme replies: “Nothing! My dignity and honor is not for sale! You have made a huge mistake in your judgment.” She leaves the meeting furiously and he shouts as she walks out: “you better leave the country and forget about all this!”
Confession
Mariamme leaves Kabul. Afraid of being pursued in France, and endangering her family, she flies to New York. After two months she undertakes legal steps. In her quest for justice, she files a complaint before the Afghan Independent Human Rights Commission (AIHRC) and Office of Attorney General of Afghanistan (AGO), providing them with sufficient documentations [proof and evidence] for investigation. though, both institutions (AIHRC & AGO) summoned Dr. Abdullah – Although before the AIHRC and the office of Attorney General, Abdullah recognizes the marriage, the threats, and stipulated charges… explains he is sorry, promises a formal divorce, the restitution of Mariamme‘s belongings and the dowry he owes her [his house in Kabul]… despite his confession, both institutions fail to implement the law, ignore their mandates, and refuse to what is expected of them “their job.”
Lack of institutional responsibility, to follow-up cases of violation, allowing the perpetrators to walk free enjoying this god-given impunity while the victims painfully face impasse, has diminished public trust in the Afghan Government and resentment toward international community … that in the face of countless reported atrocities and violations against women and girls, they remain a mere observer.
The presidential candidate Abdullah, not only fulfill his legal and Islamic obligations moreover, falsely spreads rumors to his elite friends that he has given Mariamme [10 million dollars] for her dowry. Mariamme acknowledges the lies and difficulties, but it did not prevent her from returning to Paris, hire a renowned attorney Mr. William Bourdon, to attack Abdullah Abdullah in justice in France. Dr. Abdullah, through Former Ambassador of Afghanistan to France Zalmai Haquani, who is Abdullah’s point man in France, appointed a Corsican lawyer Mr. Rinieri to represent him. Mr. Rinieri, confirms he has never seen Abdullah. Mariamme intends to hold Abdullah accountable for his violations and misdeeds, to demonstrate "that the law and justice work in France.” The investigation by French prosecutors after a year of proceedings led to the recent designation of a criminal Court Judge in Paris. The Judge has in hand all the relevant evidences. My client was also heard by French authorities, said Mr. William Bourdon, Mariamme’s attorney. Now we will put Abdullah Abdullah on trial. “Pending the judge’s decision in France” which is due soon.
Before embarking on the presidential campaign, Dr. Abdullah made some confessions on Afghan Tolo-tv. On November 11, he said he had in his life, committed a "Big mistake that hurts [him] and affected [his] family. One day, perhaps, I will pay for it …” has he mumbled, before clearing himself on the grounds that "all human beings can make mistakes.” Mariamme was listening, but more than ever determined to fight until justice prevails. She said the next step is press-conference unless, his conviction comes before.
