I'm someone who has the basic sense in their brain to know that a Muslim would never say or think the things Al Khaneeth does please do not dignify him by calling him Hanif, because is is anything but muhnaf. he is mukhnath.\

If you think otherwise, you can also take a hike as well; as a low life to tries to corrupt Islam and make it look like a disgusting system of tyranny and misogyny.

Why has this become such a complex issue in the Muslim world? The majority of us who are literate and who have done even a single Khatam e Quran and read the hadith Scimitar posted (the most familiar one seen in nearly every Mosque I've ever been to in regard to this discussion) seen to be set up a just and simple system:

I am no alim. So no need to read on after that first sentence, lol. And I would love to hear thoughts on my reasoning below:

But I thought, per my reading of the Quran that in cases of both adultery and fornication the final leg of the evidence chain comes down to an honor system of competitive oaths. Meaning that God puts the burden on the believers saying: OK, there are punishments and as true believers you are expected to carry out these orders. But, at the end of it all, you being true to the your shahadath (statement of faith) comes down to each person's ability to see it through.

The Quranic ayaahs on the subject seem to: first ask a burden of proof to be given. If there is the provided proof with reasonable and reliable witnesses or some substitute thereof, then case closed.

However, even then.... even then with witnesses and proofs, it appears that the Quran we have in our hands then says that both parties, even if the proof is tremendous can take an oath and they take the oath a certain number of times.

          So as an example:

Let us take this Afghan case as a practical implication. The two parties, the male involved and the female involved were being evaluated for two crimes: either fornication since the girl was not married and adultery for the male involved (earlier articles had said he was imprisoned). The women then said that she had actually not had any consensual relationship with the gentleman and that it was rape. So then a third consideration came into being:

So the crime list possibilities were

Male: adultery for sure... rape possibly
          Female: innocence versus fornication.

At the end of the day of the crime is prosecuted, and REMEMBER the key thing here is one cannot be purely emotional simply because this is a female. I mean what if the man did not rape her? What if it was consensual? Thats a possibility. Even in the American court system, there has to be a burden of proof established for someone to be proven a rapist. Just as she deserves the benefit of the doubt, so does he.

What it would boil down to then, if the Quranic law was executed with justice, it seems to me is:

No DNA evidence, no witness evidence that the man committed rape... but if the child is proven his, in the least he committed consensual adultery. So then his punishment would be rajm regardless.

Now for the woman, based on surah 24, she has the option of swearing a series of oaths that she did not have consensual zina with this individual and that she was raped.

And then the idea is that the weight of the sin is left between her and her Lord. She goes off free. If she was lying then she will be severely punished on the judgement day.

I thought the proof of this line of reasoning was that one man came and confessed to adultery and met the punishment, per the Bukhari hadith. Someone mocked him as he was being stoned and the Prophet rebuked the mocker indicating that the man had been absolved in this life.

So either way, in this scenario, under what I thought true shariah law says, the man would meet his end and the woman, if she were to swear a series of oaths, would be able to legitimize the issue of rape.

Forgive me if I have misinterpreted the ayaahs.

how many of them did you actually punished for their behaviour , again start to clean your own people before you start to judge the acts of others ...

i guess i have to go to a marrocon board and start to talk like you and wait how long it takes till i get kicked out ....

Lets put aside the discussion of punishment of adultery in islam...think about the news....the girl claims that she was raped...al-hanif says that she has to prove that she was raped....Abbasinafghan claims that there are lot of north african girls in france who commit zina....This is common behaviour in our muslim socities, girl is more highlited and criticized in such cases than boy and she suffers more...In this news there is character of possible rapist, neither afghan governament nor you people are interested in him...the main culprit in the story according to description is woman...it is a common thinking in our society that woman is fitna of shaitan...people take meaning of fitna in another sense...like woman is some kind of agent of shaitan created to sexually provoke man...
Few weeks ago my sufi classfellow of same batch approached me in medical ward and said to me that i should'nt talk with female batch fellows.. I said 'why?'.. He said "dena nazro zinna kegi awo imaan kamzoregi"....i pointed my finger at a bed and said to him "da bed 13 bande kom female patient prata da, ighe ta ogora"...he looked at her...i said "da female patient sara ta os nazar zinna wakrra"..with a grin on his face he said that we should try our best not to look at female patients directly and that as students we are forced to deal with female patients otherwise he doesnt want to even talk with them..i said if MBBS is so unhealty for your imaan then why dont you leave it like XYZ and go to madrassa...
I thought it was good dose, but after few days he approached me again and told me that i should stop having gup shup with my female colleauges, the fitna of shaitan.

i think they all need to be punished but according to Islamic laws, judged by an Islamic court
there is no such thing in Morocco or in France
Morocco is ruled by an apostate
                France is Dar al Kufr
trust me, I would say exactly the same things about moroccans

Her attacker is serving a 7-year prison term for the crime.

The palace statement said Justice Minister Habibullah Ghalib asked a panel of top legal officials to order her release.
Gulnaz sought a pardon from Karzai earlier this week.
"After assessing Gulnaz's case, (they) decided that her remaining sentence in jail should be pardoned under the current rules and regulations of the country and she should be released," the palace statement said.
Gulnaz was initially sentenced to two years in jail for "adultery by force," which was later increased to 12 years on appeal. She was given the choice of marriage or serving a jail sentence.
Her sentence was then cut to three years after a third appeal, and the requirement for her to marry was dropped.
Gulnaz became pregnant as a result of the attack and gave birth to a daughter in the Badam Bagh women's prison in Kabul almost a year ago.

If we have the assurance she was raped, and it is very possible.

the guy should be prosecuted by a sharia court, she should contact the local court of the islamic emirate of afghanistan, and im sure she will get her justice.
