    there was just a program about australian muslim divorce. 3 couples getting divorce with sheiks as councillors/judges.
    one man had left the wife with 6 kids and had a child with new wife. they wouldn't let the 1st get divorced without husbands approval, and he wasn't approving. one husband left the wife with their child after 2 years of marraige. she was not allowed to divorce him without his approvaal and was told she had to pay him whatever he asked, maybe $2,000, maybe more.
    pretty heavy. the women had to keep returning to beg for their divorces. 1 couple ended up back together.

    one of the older judges was saying that in the qu'ran, the man has to be the one to get the divorce. a younger judge gave an islamic divorce as she had already got a legal divorce whilst the husband had been in prison for fraud. but anther judge claimed they were not divorced by islam law.
    not so easy for the women. what happened to the womens rights as supposedly given by the prophet?

      Actually women have what is called "Khul'a" which means "evacuation" literally, they request it and the Qadi (Magistrate) approves or denies based on whether or not there is a valid case. Most of the cases here appear to be valid. so the problem isn't the system itself but who is operating it.

        the youner judge said he felt it was right by islamic law to grant the divorce due to what the man (fraud) had put the women through in his bad behaviour. even without him being there to give his, 'i divorce thee'.

          I can see where your contention would be though, it really rests on the disposition of the Qadi. It's well meaning but it is very flawed, I guess the reason behind it is to prevent women from using divorce as a black mailing scheme; but what ended up happening is that men now use divorce as a black mailing scheme and on top of that started becoming complacent with this mentality like "oh she can't divorce me anyways so I can do whatever I want!!"

          It's really stuff like this and how ineffective it is which makes me think maybe this isn't "divinely ordained" after all.

            the situation too is that some of these men are from overseas and they marry a woman from australia. that gets them into the country and availability of oz citizenship. then mistreating the woman.

              yeah it is disgusting; I tell you all the stuff that is happening and has happened to Muslims is God's punishment for how we are as a society

                me, i think humans have misinterpreted a more universal message of the prophets and created destructive divisions.
                i can't see any faith/philosophy/religon or system working, that doesn't incorporate all people as equal.
