Just for the record:

Pashtunistan as a province of Greater Afghanistan exists legally, has a flag and a provincial capital, Peshawar.

According to the Durand Line Agreement, the current areas that make up Khyber Pakhtunkhwa and segments of Baluchistan province were declared "free areas" and NOT as integral parts of former British India.

Pakistan a a sucessor state to British India is still committed legally to that agreement.
